Judge Issued Emergency Restraining Order Against Champaign County Clerk; Unsecure Ballots In Private Vehicle –

At 6:40 p.m. on Friday evening, November 4, 2022, Champaign County Associate Judge Anna M. Benjamin signed a Temporary Restraining Order against Champaign County Clerk Arron Ammons, and Deputy Clerk Michelle Jett.

The Court, in its Order, found that Deputy Clerk Michelle Jett had unsealed official ballots in her personal unattended motor vehicle and that circulation of official ballots outside the chain of custody and controls defined by the Election Code threatens the integrity of elections causing harm to the public and Plaintiff.

It also found that the verified allegations, affidavits, and factual matter stated in the Complaint establishes that Plaintiff and the public have a protectable interest that is threatened, and that the benefits to the Plaintiff and the public of emergency injunctive relief far outweigh any burdens to the Defendants.

From the Order:

  • Champaign County Clerk, Aaron Ammons, is enjoined from assigning any election duties to Michelle Jett
  • Champaign County Clerk, Aaron Ammons, is enjoined from allowing Michelle Jett any access to any election equipment, ballots or other election materials
  • Michelle Jett is enjoined from performing any election duties
  • Preliminary Hearing scheduled for November 7, 2022, at 10:30 a.m.
