DuPage Township – “Investigation into this matter and any charging decision remain ongoing” – Will County State’s Attorney

Earlier, we confirmed the FBI had taken over the Bolingbrook Police Department’s investigation of alleged criminal activity by former DuPage Township Supervisor Bill Mayer and published this article on that fact in September.  As we stated in that article, the Federal authorities never disclose the status of an investigation.

Shortly after that publication and throughout the past several months, Trustees Burgess and Oliver took to social media with attempts to convince people if there was anything done wrong Mayer would have already been charged.

While we have witnessed first hand the US Attorney taking up to the last day of a 5-year statute of limitations before charging, waiting two years is nothing new.  With continued claims there is no investigation by those trustees and others, we filed a couple of Freedom of Information Act requests to see if it would flush out any key information.

As of this publication the Bolingbrook PD has failed to comply with our FOIA request for certain records pertaining to the criminal investigation.

However, the Will County State’s Attorney has responded and the response confirms what we already knew.

“The investigation into this matter and any charging decision remain ongoing, and releasing any of the requested material would impede that investigation

I requested the following records:

  1. Copy of the investigation records regarding the criminal investigation of former DuPage Township Supervisor Bill Mayer. This would include interviews, audio/video recordings, and any other records created during the investigation.  These records would have originated from the Bolingbrook Police Department and forwarded to the State’s Attorney for a charging decision.
  2. Copy of all communications with the FBI and any records they provided to Will County State’s Attorney Office regarding the investigation of former DuPage Township Supervisor Bill Mayer.
  3. Copy of any charging decision made regarding former DuPage Township Supervisor Bill Mayer.

Considering there is in fact an ongoing investigation into Bill Mayer, as well as the charging decisions remaining ongoing, it should put to rest the claims no such investigation is happening. Within the response, we note that part of the reason for the denial was the potential disclosure of “individuals” (plural), who have provided information in the course of the investigation.

A copy of the Will County State’s Attorney’s Office response to my FOIA can be downloaded at this link or viewed below.  We have narrowed our request for other records so as not to be unduly burdensome in hopes of being able to further validate what crimes are being alleged in the police reports.
