Gov. Pritzker’s Executive Order makes criminals of unsuspecting gun owners?

On April 25, 2020

Illinois (ECWd) –

Illinois Governor Pritzker might be well advised to find new legal counsel, unless this was intentional, as it appears his upcoming Executive Order taking effect May 1st, 2020 does one of two things.

  • Strips a gun owner of his rights while complying with the Executive Order to wear a mask, or
  • makes them a criminal if they exercise their gun rights while complying with the Executive Order to wear a mask.

Proposed May 1, 2020, Executive Order

“Wearing a face covering in public places or when working. Any individual who is over age two and able to medically tolerate a face-covering (a mask or cloth face- covering) shall be required to cover their nose and mouth with a face-covering when in a public place and unable to maintain a six-foot social distance. Face-coverings are required in public indoor spaces such as stores.”

Criminal Code

Sec. 24-1. Unlawful use of weapons.
(a) A person commits the offense of unlawful use of weapons when he knowingly:

(9) Carries or possesses in a vehicle or on or about his or her person any pistol, revolver, stun gun or taser or firearm or ballistic knife, when he or she is hooded, robed or masked in such manner as to conceal his or her identity;  (this violation is a Class 4 Felony)

Considering a mask that covers the mouth and nose will clearly conceal a person’s identity, those people complying with the Executive Order by wearing a mask while also exercising their right to bear arms, both under the State Constitution, US Constitution, and Illinois Firearms and Concealed Carry laws would be violating the criminal code.

This is yet another example of a political figure invoking rules upon citizens with little to no regard for their constitutionally protected rights.

    Clearly you have not seen the response from the ISP and how they very carefuly left the barn door open on this matter. While I believe they could never get a conviction, I do believe and know rouge cops that would arrest certain people just to make their life miserable. And YES, a mask covering your mouth, nose, cheeks, does hide your identity.

    “Is anyone working on filing a law suit.” No. Why? Because no one is going to get arrested for this – unless they are being stupid and trying to “test” the law by wearing some clown mask while armed. Your face consist of eyes, nose, forehead, mouth, cheeks, and entire surrounding texture of head. Wearing a mouth and nose protector is NOT a mask to hide your identity.

    First, you aren’t wearing a mask to hide your identity. No intent.
    Second, you aren’t hiding your identity. Your nose and mouth alone do not make up your face.
    Third, read the plain purpose of the statute – HIDING YOUR IDENTITY. You are NOT hiding your identity. Now, as I mentioned earlier, you’re going to have some imbecile who will try to push the boundaries and will wear a mask and arm himself – and claim he is doing it to “protect himself from the virus.”

    Here is a guy in Pritzker,who never had a real job, never worked a day in his life simply holding the citizens of this state as hostages. The real goal here is to extort more money from the Federal Gov to pay for the mismanagement and corruption Illinois has endured for decades. You see the talk in D.C. of additional funds to bail out states near bankruptcy. What better method to achieve this than to destroy Illinois’ economy and keep it under water. I wouldn’t be surprised if Pritzker extended these authoritarian orders indefinitely. I hope not one more penny is sent out as bailout funds. For those most vulnerable, take all the precautions necessary to keep YOURSELF healthy. For the 80% of us who are healthy, buck these foolish decrees. I haven’t changed my behavior at all. And I won’t be wearing a mask. This over-hyped madness has to stop!

      Wow, you’re probably the only other person beside me that can see why IL and other failing states are leveraging off of this virus to extort federal money to pay for their social agendas. Their daily speeches clearly point to that, but for some reasons, most Americans have no clue how to parse their rhetoric. Have America become so soft and complacent that we no longer know how beautiful our Constitution is and how unique it is?

      To add salt to injury, having an obnoxiously unhealthy pig like JB, who is a candidate for a ventilator, preach and lie how he’s protecting us and saving our lives, is just too funny. In fact, just look at the Chicago daily press briefings, they’re ALL candidates for ventilators, and they should all be tested and quarantined. Why aren’t more people or the media noticing this?

      Even when a lone reporter yesterday inquired why JB’s wife traveled to FL, he basically brushed off w/o any response.

      Also, he keeps refusing to provide any data to back up his reason for extending the EO, refusing to disclose the number of recovered cases, and vaguely referring to data coming from NW University.

      Has no one noticed that his family endowed that school with hundreds of millions a few years back? Can you imagine his office calling NWU asking for support data to use for his EO, would any faculty or scientists there insist on providing only significant statistical data? NWU would fire those folks in less than a heartbeat.

    This argument is so dumb… the governor is not trying to take away gun rights. 1. The mask is a suggestion. 2. You are not allowed to have carry a gun in the places where the mask suggestion applies to anyway. 3. According to the highlighted section you can’t be hooded or a “robed” either, soooo how come no one was making a big deal about this before the mask suggestion?

          Also Gordon, if you must know, not only am I am American, I am the daughter of an American farmer. I grew up learning how to work hard, appreciate what you have, the consequences of being selfish and expecting that things are not always going to work out the way I want. I also grew up working in an American, family owned, female operated restaurant. Along with a multitude of other skills, that taught me the importance of effective communication, team work and patience. All of these skills are what helps me when I encounter people like you.

      What you fail to understand is this is a question of a governor forcing a specific part of his state’s population to give up God given rights. This will only effect law abiding citizens not the criminals who don’t care anyway. This is a corrupt system taking away more rights of the law abiding under the ruse of public safety. Which is a lie considering we have yet to hit the number of infected or dead that the regular old flu effected this year. Wake up and check all facts.

        I think what you fail to understand is that the advice to wear a mask is a suggestion, not a law. There is no forcing of any kind, it is a request for cooperation to do what we can to stop spreading this illness.

        In the 2016-2017 flue season there was 61,000 flu-related deaths.
        In the 2017-2018 flu season there was 34,200 flu-related deaths. 
        As of today there have been 61,288 covid related deaths. You should also keep in mind that we have only been counting covid related deaths for 6-8 weeks now, sooo I’m no math wiz but that means there will likely be a lot more covid related deaths than there are for the flu. It seems like maybe you don’t have your facts in order?

        There is no good reason for people to be deliberately uncooperative on such a small request. If everyone truly wanted to get things up and running, everyone would be willing to do any small thing they can to help out.

        If you could give me an example of someone legally carrying a concealed weapon, that was arrested because they were wearing a mask in cooperation with this request, then I will be right there with you during the uprising.

          As for fantastic reasons not to wear a mask:

          A.) Not a coward
          B.) Not a criminal
          C.) Not a woman of the Islamic faith
          D.) Not a surgeon about to do surgery on a patient
          E.) Not feeling the need to virtue signal and buy into the fear hype
          F.) Am an asthmatic with already restricted airways.
          G.) Group activities aren’t really my thing.
          H.) Like my freedoms and the Constitution guarantees them.
          I.) Don’t adhere to the decrees of either wannabee or real monarchs and dictators
          J.) Already beat way more scary illnesses than the Wu Flu
          K.) Masks reduce oxygen flow and lack of oxygen kills brain cells.

          Also, two additional thoughts for you:

          1.) Appeal to Fear is a logical fallacy. Fear shuts off your frontal lobe (the place where you do your higher level reasoning, assuming you didn’t obliterate it by somehow reducing your oxygen flow) and makes you stupid by invoking your fight or flight reflex.
          2.) If what the governor is making is really just a suggestion or request, why is it going to be enforced by the Illinois State Police?

            On the part about a mask reducing your oxygen intake… so that would mean that doctors, construction workers, farmers (the list goes on and on) are losing brain cells on a daily basis from lack of oxygen…? Lol, ok. I’m guessing you are against winter scarves to lol.

            I will look forward to reading your lawsuits, it might be hard to get a judge to hear you cases though. Typically something actually has to happen to you before they will spend time hearing “your side” of the “story”.

            We all know it’s not a law, but that doesn’t stop them from dialing up the fear by threatening police arrest. An alderwoman in my ward was interviewed last week by ABC, where she was so excited about enforcement to wearing masks, and even blurted out that she’d “rather ban running” so that runners can’t spread the virus while they breathe heavily from running. This evil woman even went as far as using the Czech Republic as an example for us to follow, because over there, it’s wonderful that the government can arrest and fine people for not wearing masks.

            Then of course, after the fear tactics and the wish for a socialist state didn’t seem to work, as most people ignore the fences around the lakefront anyway, these leftists resort to invoking God as a way to manipulate people into compliance. That’s funny, since these leftists, who actually cheered when JB allowed late term abortion, are as Godless as anyone can get.

The governor can’t dictate what people do or do not wear. Also, the more people who do not comply, the easier a time all of us who will not comply will have. they cannot get us all which means they cannot get any of us in the long run.

      You are allowed to conceal carry in stores unless posted otherwise, and you can carry while wearing a hooded sweatshirt or jacket. He is, along with his fellow democrats, trying to take away our second amendment rights. Every gun owner I talk to say they will never give up their firearms under any circumstances.

The “Simple Fact” is that the Executive Branch “CANNOT” issue an E.O. that “KNOWINGLY” causes you to violate an ILCS put in place by the Legislative Branch without the Judicial Branch signing off on the original Court Order to put the aforementioned ILCS into Law or the Legal FOID Toting Citizens of the State of Illinois will be allowed the Right to Open Carry

    The fat pig in office has no idea how the common man lives. Sure, he is taken care of but what about the poor people that can not work or earn money to feed their children? I’m surprised that he allowed us to purchase seed and other garden supplies to grow our own vegetables. Concealed carry should not be played with such as what he is doing.     What I wear or don’t is none of his business. I’ve been locked away in my house for more than 2 months now. Pretty darn sure I don’t have Kung Fu Flu. Meanwhile my husband goes to work 5 days a week and has not brought it home to me yet. We live in the WORST STATE in the country when it comes to corruption and dirty politicians. D’s or R’s, it’s made no difference. We’ve had some of each sent to prison in my lifetime. Madigan RUNS EVERYTHING in our state. Nothing gets done here without his seal of approval. I was born in St Louis and lived my 1st 6 weeks of life over there. This has been my home for 61 yrs. THE ONLY THING that keeps us here is simply this. We have kids and grandkids here. If we didn’t, we’d of left this state yrs ago. They’ve taken our beautiful state and turned it practically into a damn 3RD WORLD COUNTRY. You couldn’t PAY ME to go up north. I feel sorry for the folks that live up there. It’s unconscionable how that City to the north has been ran for decades. If those folks had any sense they’d vote every last one of their political idiots running the show in the Chicago area out of office.
    As for how many have gotten sick with this crap here in Illinois, look no further than Chicago. THAT is where the biggest part of the problem lies.
    Whatever will they do once this dies out/off? Just another politician trying to be a little dictator here in Illinois AND I FOR ONE, am seriously sick of it.

    THIS IS RATHER TYPICAL OF ALL THESE “PUBLIC HEALTH” DECREES. They have not been studied and thought out well enough before the decree is announced. If the State Police has any sense, they should go back to the Governor quickly and get him to change some wordage rather than cause problems one way or another for citizens and then have a lawsuit against the State.

    The issue that those who clamor on about this being a public health issue seem to forget the fact that government does not have unlimited rights to do and say as they please. They have to work within the constraints of the constitution. The executive branch can blurt out EO’s but they are not in all cases enforceable in court. There is nothing in the law that says you have to wear a mask in public. They can ask, they can educate but they cannot convict.
    If anyone has been paying close attention, the death rate from this virus is similar to that of the seasonal flu. unfortunately older people and individuals with compromised immunities die from both.
    Face coverings do not make you immune from a virus. There are ways to make yourself 100% immune from being in contact with the outside world and those that feel the need should take those steps instead of trampling on the rights of others. If you don,t feel safe than stay home, place yourself and your family under strict quarantine conditions because if you don’t and you feel that this virus is that deadly than you are as guilty as those you bemoan around you that are vocal about their rights.

    So, is an armed police officer driving a police car while wearing a face mask committing a class 4 felony?

    Think about this. Because the attorney or assistant to the governor who wrote this mishmash of an executive order didn’t.

      The mask alone with valid CCW would not stand in court, they’d have to have Probable cause/another crime to charge you with (in other words the mask is an enhanced charging factor). It would help if laws were written in plain English but once you read enough of them you can easier ascertain what they mean.     I am reminded on a daily basis that our nation has become filled with people who have confused constitutional rights for the absolutely non-negotiable permission to never be told there are limits. In this instance, I would encourage you to research the court case Jacobson vs. Massachusetts specifically the Supreme Court decision as related to government restrictions of citizens rights in certain circumstances. This is a public health issue. Illinois has one of the highest rates of infection in the entire country. I don’t know if you’ve been paying attention but, right across the river, Missouri has 80% less cases and and less than 1/8th the number of deaths. If not being able to carry a weapon is that large an inconvenience, simply don’t wear a mask. My guess is that if you’re in southern Illinois or the more rural parts of the state, the local law enforcement won’t do anything about it just as many of them refused to enforce the concealed carry ban. Logically, you have to know that carrying a firearm while wearing a mask that covers ones face is a terrible idea, it makes everyone less safe from the person doing it to the cops on the street so, yeah, put your desire, ( and let’s be honest, it’s a desire not a need), to carry a firearm above your health and the health of others and just go without the mask! Problem solved!

      How exactly does it make everyone less safe? Wearing a mask does not inherently make you safe or unsafe when carrying a firearm. It’s your intention and and that isn’t changed by the presence of a mask.

      Simply citing a court case doesn’t make you more intelligent or better justifies your opinion. Yes, it’s still just your opinion. The Constitution is still intact, for now at least, so skip over all of your hidden desire to obey or illusion of safety, and consider that this is still America.

      It’s not for you or any governor to say what my desires or needs should be. It’s not required by law or the Constitution for me to worry how you conduct your life or your health.

      Throughout this crisis, we now know that having bad health is not good if you get the virus. Maybe all of you state-control freaks should worry more about your own health and get in better shape, so that when you get sick, you’ll have a fighting chance.

      This preaching of the public good is running thin and hypocritical. Having a fat pig drooling while telling me what healthy should be is truly and ironically funny. Seeing Lightfoot flanked by her panels of posers, who by the way, are ALL not the picture of health, preaching about health and saving lives is also just comical. They’re better off just promoting fitness and exercise as a way to boost your immune system to fight the virus.

      Reasonable Americans know better to take care of their own family and health than socialist wannabes want to accept.

    This is a clear example of a dysfunctional, overreaching, and power abusing state government that is operating contrary to the Illinois Constitution. Any law which is repugnant to the Constitution IS null and void as outside the scope of powers delegated to state govt. That is not an issue in the realm of personal judgment or opinion. It’s an issue of FACT.

    The EO cited in your article makes you wonder whether a new 1983 suit might be on the horizon, followed by a US DOJ Certificate of Interest.
