Florida’s Updated Vexatious Litigant Law And List –

Vexatious litigants.

Earlier this year, Florida’s Governor DeSantis signed an expanded Vexatious Litigant law, which became effective on July 1, 2025.

This comes a few months after the Florida Supreme Court’s Workgroup on Vexatious Litigants issued its final report and recommendations (here).

The Florida Bar published an article explaining the new changes in this law (here):

Dealing with vexatious litigants is far from the humor of the witches and warlocks in the sitcom, Bewitched. They disrupt the court system, hindering the timely administration of justice without legitimate purpose. Opposing parties, judges, and court personnel bear the brunt of this behavior, affecting other litigants whose court proceedings are unfairly delayed. Since 2000, Florida has sought to mitigate the impact of vexatious litigants. Now, with the passage of the recent amendments, Florida’s Vexatious Litigant Law has expanded the statute’s applicability and strengthened sanctions, providing parties and courts with more effective tools to address vexatious conduct. Vexing litigant be hexed.

The Florida Supreme Court maintains a list of adjudicated vexatious litigants in Florida, which can also be used in federal courts should the need arise. It is updated when new litigants are identified.

Illinois does not maintain a state-wide list; however, some federal courts do maintain a listing of “restricted filers” similar to this one in the Northern District of Illinois.
