Village of Kansas Ignores Key Subpoenas

Edgar Co. (ECWd) –

The Village of Kansas was a recipient of multiple subpoenas, two of which were from the defense attorney for the local citizen who was arrested for an alleged felony destruction of government property, as covered in this article.

According to the subpoena, it was for records only, and the requested records were to be provided to the Edgar County Circuit Clerk no later than September 18, 2026.  It is our understanding that the village has not provided any response to this subpoena.

The requests were for the following.

  • Copy of all drainage maps, for owned or controlled by the Village of Kansas, Illinois
  • A listing by location of all drainage pipes owned or controlled by the Village of Kansas,
    Illinois.
  • A repair log for all repairs made to damaged drain pipes in the Village of Kansas from
    January 1, 2021 up and through July 14, 2026.
  • Any and all reports, video recordings, audio recordings, reports, notes or other tangible
    documentation of interview(s) of witness( es) claiming to see the above named
    Defendant engaging in damage to state-supported property from January 1, 2026 to the
    present.
  • All phone calls received on June 25, 2026, regarding any citizen complaints of persons
    doing alleged harm to sewer pipe within the village of Kansas.
  • A call log of everyone phone call placed to Kansas Police Department on June 25, 2026.

According to the court docket, the original preliminary hearing scheduled for October 19, 2026, was vacated.

“On Court’s motion hearing on 10/19/2026 is vacated and rescheduled to 11/02/2026 at 2:00 pm.”

Failure to respond to a subpoena can result in contempt charges; however, considering it’s a public body ignoring it, we won’t place any bets on this ever happening.
