Shelby County Auditor Terminates Agreement With County –

By John Kraft & Kirk Allen

On October 17, 2024

Shelby Co., Ill. (ECWd) –

After the frivolous and unwarranted subpoena (which was later quashed by the court) filed by Shelby County State’s Attorney Ruth Woolery against the county’s contracted auditor, and after the County Board Chairman and Vice-Chairman both resigned from the board, the contracted auditing firm for Shelby County terminated its contract, as it has the right to do, in a letter delivered to the county clerk and county treasurer.

The termination letter indicated:

During the past two weeks, Shelby County has experienced the resignation of key members of its Board of Commissioners which we believe will cause significant disruption in our ability to effectively perform the FY2023 audit. As such, we are terminating our agreement to perform the FY2023 audit, effective immediately.

We wish Shelby County good luck in finding an auditor for the most recent and future audits. It will most likely come with a steep price since the county has made little to no attempt at complying with deficiencies noted in previous audits.

So the contract was terminated by the auditor. Payment for the 2022 audit was received, if not in whole then partially, and it was presented at a regular board meeting back in September that the FY22 audit was done if I understand correctly. Then last evening it is discovered the FY22 audit was actually not completed. So did the audit firm complete the work on the FY22 audit or not? Based on last evening’s budget meeting it may not have been. It sounds as though some substantial pieces are still not delivered and /or submitted. I do realize there are components needing entry by the County treasurers office but there are still large components of this audit that are lacking in completion. Is the auditing firm still going to honor their original contract and complete that FY22 audit?

What was terminated was the 2023 audit portion, not the 2022. As we understand it, the actual figures in the audit report are final. The other stuff that has to be uplaoded or transmitted to the comptroller etc. is why they say the audit is not done. The auditing of the county financials is done and there does not appear to be any other financial changes to the report that was approved.
