Shelby Co. (ECWd)-
Shelby County State’s Attorney Ruth Woolery issued a subpoena to the County Chairman (copy here) and we understand one was also sent to the auditing firm but do not have a copy of that one at this time. A request has been made for it.
The issuance of such a subpoena by an attorney to their client establishes a conflict for future representation. We believe the Chairman has grounds to demand counsel be appointed by the court for representation regarding the subpoena and potentially all future county board business.
We can’t comprehend why a subpoena was necessary for records that would become subject to the Freedom of Information Act after the public meeting in which they were discussed. We understand department heads were demanding copies, but the fact remains, drafts are not subject to review by department heads or anyone else for that matter unless and until referenced and cited by the head of the public body in a meeting, just as we outlined in this article.
