Court Issued Restraining Order Against Bond County Schools – re: masks

BOND CO., IL. (ECWd) –

A Bond County Circuit Judge sign a Temporary Restraining Order against Bond County Community School District #2, prohibiting them from requiring five Plaintiff students to wear a mask while on school property of in school buildings, without a lawful order of quarantine.

This TRO is effective until 4:30 p.m., October 26, 2021.

A Preliminary Injunction Hearing will be held at 9:00 a.m. on October 26, 2021, in Bond County Circuit Court.

From the Order:

Only as to the named Plaintiffs, while they are on school property, the Defendants, are enjoined from requiring them to wear a mask for the purposes of allegedly preventing the spread of an infectious disease unless the parent or legal guardian of a student consents or there is a lawful order of quarantine having been issued against a particular student from the local health department.”

    With the circuits courts recent findings in both the 4th and 5th appellate districts, are there any similarly situated cases developing in circuits courts residing within Illinois 2nd or 3rd appellate district?
