Marion County Coroner sued under Freedom of Information Act –

Marion County, IL. (ECWd) –

A lawsuit under the Freedom of Information Act was flied this week naming the Marion County Coroner as Defendant.

On March 30, 2020, Shane Lyberger asked Marion County Coroner Troy D. Cannon for public records consisting of certain financial records of the Coroner’s Office.

According to the Complaint, Cannon refused to properly respond to the request until after the COVID-19 crisis has passed.

A request for review was sent to the Attorney General’s Public Access Counselor, who after several requests to the Coroner for a response, determined the Coroner violated the FOIA by not responding to the AG’s Office, and that the Coroner had a duty to respond to FOIA requests.

After still not receiving a response from Cannon, Lyberger filed this Complaint.

Lyberger’s Complaint asks for the requested records, attorney fees and costs, and a civil penalty of $5000 payable to the Plaintiff.

This is case Number 2020-CH-40 in Marion County Circuit Court.
