Hutsonville Public School District notified IDPH/ISBE it declines to implement Joint Directives –

Hutsonville, IL. (ECWd) –

Hutsonville CUSD #1 has sent a letter to the Illinois Department of Public Health and Illinois State Board of Education informing them that they are declining to implement the health and safety protocols as outlined in the 63-page “Joint Guidance” document published last week.

The public school district provided the following in the letter:

  • there is no substantive authority supporting the basis for promulgating these guidelines
  • no legitimate legal source delegating administrative agencies any lawful authority to mandate such rules upon public or private schools, parents, or students
  • no legislative act delegating authority to place such demands upon public or private schools, parents, or students
  • a 1922 Illinois Supreme Court case, Barmore v Robertson, deemed general health regulations such as these as beyond your authority when it stated that “Health authorities cannot promulgate and enforce rules which merely have a tendency to prevent the spread of contagious and infectious diseases.”
  • Governor Pritzker has admitted no enforcement mechanism exists
  • this school district will determine what, if any, additional health and safety protocols it might choose to add for the upcoming year, and they are reasonably certain any such protocols will not include a mandate that staff , parents or children be required to wear any type of face coverings

    Oh, that the IDPH, ISBE and Illinois Attorney Generals office had the caliber of counsel and representation of Thomas DeVore! Illinois would then start to be a great state again if the elected officials would follow his type of counsel.

    That is the main trouble with politicians, they don’t want to follow the law and have legal counsel that tries to go around the law. Mr. Devore follows the law.

    Requiring face coverings AND a one-size-fits-all social distance standard ain’t supported by the document references! So unreasonable is this conjoined approach that it has the effect insulting legitimate providers.

    I think it will be impossible for schools to keep masks on kids. The State may choose to keep schools closed.

    Unfortunately, the ISBE and the the IDPH seems to get their legal advice from the Governor. Would you believe that man has a law degree? Yeah, me either. He must have gotten it Lori Loughlin style. Carmen Ayala and Ngozi Ezike, seek your own legal council when making mandates for the state. Tomorrow is going to prove following the Governor will only get you in legal hot water. 😉

    Hope more school districts follow suit, but not likely. Remember folks, none of this is about a virus, it is about the November election. Democrats trying their hardest to keep this narrative alive hoping it will help them in the polls in November. Would be great if more people start homeschooling. That would mean less indoctrinated children.

      Mags, I don’t want to homeschool, but I will if this nonsense isn’t thrown out before mid-August. I love my kid’s school and they aren’t happy about this either. Unfortunately, we have a Governor who skipped Government class in high school, college and law school and thinks the U.S. is a dictatorship. (And seems to be advising the IDPH and ISBE.) I hope this is thrown out before mid August, I’m confident it will be thrown out, but unfortunately court takes time.

    Send.these articles to your school boards and superintendents guys asking them to do the same! I am in conversation with the DuPage regional superintendent regarding this. Put the pressure on!!!

    Although the cases in Crawford county are low at the moment, this can change dramatically as people who do not obey the masks, social distancing and hand washing guidelines travel in and out of the county. Schools are an incubator for disease. If those of you that do not follow legitimate news would get informed about the COVID-19 blowup in the southern states, you might change your mind. Whenever, there are large gatherings by those that ignore the guidelines, significant spikes occur. If schools do not follow proper guidelines, the same spiking will occur in those communities.

    We follow the guidance of our medical/health professional for other situations. So why now do we not want to follow the guidance for COVID-19, a highly contagious virus?

    Europe has controlled the virus by masks, social distancing, and hand washing. This is making us look really stupid to the rest of the world, which is now banning travel from the United States. Quit listening to the Russian bots and recognize reality!

      Rodney, here is the American Academy of Pediatrics stance on how the virus effects children:

      Policy makers must also consider the mounting evidence regarding COVID-19 in children and adolescents, including the role they may play in transmission of the infection. SARS-CoV-2 appears to behave differently in children and adolescents than other common respiratory viruses, such as influenza, on which much of the current guidance regarding school closures is based. Although children and adolescents play a major role in amplifying influenza outbreaks, to date, this does not appear to be the case with SARS-CoV-2.

      They also realize masks on young children may make them more likely to touch their face and could do more harm than good. As well as the fact that developmental disabilities could make a mask impossible. Do you not consider them to be a reputable health agency?

      And sorry, Europe’s perception of me has absolutely no bearing on the decisions I make for my children. But thanks. 😉

      One last thing I’d like to add, despite all the media attention about cases going up, there is one fact they forget to report. Deaths are going down. But carry on with getting your news from your legitimate news sources.
