St. Clair County Judge sues city, county, state for malicious prosecution

St. Clair CO., IL. (ECWd) –

Madison County Judge Ronald R. Duebbert has filed a complaint in Federal Court naming the following as Defendants:

  • St. Clair County
  • Office of the State’s Attorney Appellate Prosecutors of the State of Illinois
  • State of Illinois
  • City of Belleville
  • Brendan F. Kelly, former St. Clair County State’s Attorney
  • Lorinda Lamken-Finnell, Special Prosecutor of the State of Illinois
  • David Robinson, Special Prosecutor of the State of Illinois
  • Alex Enyart, Special Victim Advocate
  • Detective Daniel Collins, Belleville Police Department
  • Timothy Crimm, Bellville Police Department
  • Carlos Rodrigues, Complaining Witness

Judge Duebbert won election as Madison County Judge in November of 2016 and has been allowed to serve as an elected judge since he was sworn in – more than 2 years.

The Allegations:

Brendan Kelly: Participated, directed, and controlled the investigation until he handed it off to Illinois Appellate Prosecutor’s Office, and continued to participate after the hand-off. That Kelly was personally involved in directing and consenting to the fabrication of evidence. Suppressed exculpatory evidence tending to prove innocence of the crimes charged.

Lorinda Lamken-Finnell: Personally involved in directing and consenting to the fabrication of evidence. Suppressed exculpatory evidence tending to prove innocence of the crimes charged.

David Robinson: Personally involved in directing and consenting to the fabrication of evidence. Suppressed exculpatory evidence tending to prove innocence of the crimes charged.

Detective Daniel Collins: Personally involved in directing and consenting to the fabrication of evidence. as well as the suppression of exculpatory evidence.

Detective Timothy Crimm: Personally involved in directing and consenting to the fabrication of evidence, as well as the suppression of exculpatory evidence.

Alex Enyart: Under color of law helped procure false affidavits, personally involved in directing and consenting to the fabrication of evidence. as well as the suppression of exculpatory evidence.

Carlos A. Rodriguez: Swore under Oath to one or more false affidavits, which formed the sole basis for the investigation of Plaintiff, and was personally involved in the fabrication of evidence.

A detailed timeline is found within the Complaint (below) which alleged the fabrication of evidence and crimes after Duebbert won election as Circuit Judge.

In his 9-Count Federal Complaint, Duebbert is complaining of violations of the following:

  • Due Process,
  • Failure to Intervene,
  • Conspiracy to Deprive Constitutional Rights,
  • Malicious Prosecutions (Federal Claim),
  • Malicious Prosecution (State Claim),
  • Intentional Infliction of Emotional Distress (State Law Claim),
  • Civil Conspiracy (State Law Claim),
  • Respondent Superior (State Law Claim), and,
  • Indemnification (State Law Claim)

He is asking for damages in the amount of $10,000,000.00 in compensatory damages, punitive damages against each individually named defendant, plus costs and attorney’s fees.

    Well Brendan Kelly now has the Power of the State Police at his command. Think this will cause him not to be certified as Director of the ISP? I doubt it.
