John Bank and Onarga Library Board illegally vote to remove Library Trustee –

Those are but a few words which came to mind, along with “who do these people think they are?,”  while we were trying to figure out what the Onarga Public Library District Board of Trustees did last fall, and how they tried to justify their apparent illegal activity.

This one is going to be good, so keep reading.

The Onarga Public Community Library District Trustees are elected officials and public officers, in the public office of Library District Trustee, just as many other library districts in the state of Illinois. As a Library District, it must comply with the Public Library District Act and the Election Code, among others.

The Illinois Election Code defines a “Public Office” as any elective office (10 ILCS 5/9-1.10), and defines a “Public Official” as any person who is elected or appointed to a public office (10 ILCS 5/9-1.11). So there is no mistaking the significance of those definitions, it essentially means that if an elective public office (let’s say, Public Library District Trustee) becomes vacant, and someone is appointed to fill the vacant elective office, it has the same force of law as if that person was elected to the office.

For this first article on their removal of a Library District Trustee, we will simply provide you, for your amusement, with what the Board did during its October 12, 2018, Library District Board of Trustees meeting. Later articles will explain how we believe they violated the law with this action:

  • Chairman John Bank (who has been Chairman of this Board for at least the past 17 years, which is 16 years too long) states that it was his duty to remove Doris Hubner from the Board, and since he appointed her, he can rescind his appointment (of course this “duty” of his is completely fabricated, as is his power to rescind any board appointments):
  • The Board votes to remove her from her position as the elective public officer of the office of Library District Trustee
  • Chairman Bank, fabricating a false and nonexistent power out of thin air, states (as if he is performing a marriage ceremony) “with the power granted from the State of Illinois I remove Doris [Hubner] from the Library Board“:
  • The Library Attorney, George P. Cuonzo, goes on a 5-minute vomit-inducing embarrassment to the entire attorney profession:

    I vote we start turning incomplete or should I say manipulative attornies into the ARDC. I’m going to once I get a certain opinion back from the IL AG! The ARDC May dismiss it but If anything maybe it will be a wake up call that we are no longer going to tolerate the bulling behavior of municipal attornies
