College of DuPage – State issues record destruction suspension citing “pending evidentiary requirement” concerns.

By Kirk Allen & John Kraft

On April 5, 2016

DuPage Co. (ECWd)-

In what appears to be an unprecedented move in the State of Illinois, the Chief Deputy Director of Office of the Secretary of State, Illinois State Archives Records Management Section, has now taken pro-active steps against the College of DuPage.

All record disposal activities at COD are suspended until further notice!

Chief Deputy Boots cites pending evidentiary requirement concerns as the justification of the suspension effective April 1, 2016.  In addition, the suspension will not be lifted without direct consultation with State Representative Dwight Kay who contacted them after reading our first article on the subject.

Thank you Representative Dwight Kay for getting it!

For those that wish to take the position the record destructions that took place at COD were legal because the state approved the destruction requests, you need to understand that the requester failed to notify the State of the legal matters taking place at the College.  Had that obligation been met as the law outlines, the State would have never approved them.

The immediate suspension of records ordered by the State is a perfect example that you can make a difference and you can fix your local government.  We appreciate those who truly understand the impact record destruction can have on civil and criminal proceedings.

Below is a copy of the e-mail communication from the State to Representative Kay.

Curiouser and curiouser… could it be a preemptive measure against the destroying of evidence.. 🙂

Jeanne, Feel free to contact Rep. Kay and ask him why he got involved. Ask if it was tied directly to our exposing records were being destroyed in violation of the law.

Tooting your own horns is not necessary. It is distasteful and not civil.

They should be proud! It’s almost as if Jeanne doesn’t appreciate fraud, waste, abuse and corruption being exposed. Very disheartening. Maybe she would like to pay my tax bills?

I love the fact they cite their well earned accomplishments…. they do it in such a tasteful and civilized manner.

Usually, the only people who don’t want the watchdogs to disclose the truth are the people with something to hide.
