DuPage County State's Attorney office validates COD legal advice to the Board

DuPage Co. (ECWd) -

During the last College of DuPage Board of Trustees meeting Dianne McGuire tried to make the case that the closed session recording requested by the States Attorney Bob Berlin must not be released without a protective order that ensures the closed session recordings are not released by the States Attorney.

McGuire and her antics can be viewed by going to the 2:07:45 mark of the video at this link.

McGuire has been very public about her distrust of the advice of the legal counsel provided by Tim Elliot and refused to support the release of the recording even after being given proper legal advice that a protective order is already built into the statute.

We now have validation from the States Attorney's office that the legal advice provided by Tim Elliot was in fact spot on.  In fact, Berlin's office points to the very same statute section that Mr. Elliot read to the Board in response to McGuire's comments.

    To continue the article, the board motion passed so now the February and March 2014 closed session minutes of the COD Board will be sent to the DuPage County State’s Attorney’s office so they can review if the board complied with the provisions of the Open Meetings Act.
