Mahomet Township’s attorney, Mr. Michael A. Kraft, thinks he can demand that previously provided records under FOIA be destroyed, those emails deleted, and prohibit the FOIA requester from providing those records to anyone else.

As set forth in my email below, you are again directed to immediately destroy any printed documents from yesterday’s document disclosure and to completely delete yesterday’s email attachment with those documents and any copies thereof. You are on notice that this is confidential and proprietary information that may not be shared with anyone.
Thank you for your understanding and cooperation.
It is already well-established that records provided by a public body under the Freedom of Information Act cannot be clawed back and the distribution of those records cannot be limited by the public body for any reason absent a court order, which is rarely granted.
So what if you provided some things you shouldn’t have provided.
That’s your problem, not the problem of the FOIA requester.
Quit making unqualified demands of them.
