Shelby County And Dive Team Sued Again For Public Records –

Shelby Co., Ill. (ECWd) –

Shelby County and the Shelby County Dive Team were once again named Defendants in a Freedom of Information Act (“FOIA”) Lawsuit alleging the county and its dive team failed to properly respond to several FOIA requests for public records.

The FOIA requests in question were submitted between May 2024 and November 2024.

Responding to public records requests and providing public records is a “primary duty” (See 5 ILCS 140/1) of public bodies in the State of Illinois.

The public records requested were for copies of:

  • FOIA #1 – no response provided to requester:
    • authority for dive team to bill individuals
    • all invoices and communications from dive team and insurance company
    • all communications and reports of individuals on file (provided)
  • FOIA #2 – no response provided to requester:
    • Same as #1, but also included “2017 roster and current roster”
  • FOIA #3 – no response provided to requester:
    • information on the fundraiser for the dive team on July 2024, specifically, proof the money was given to the treasurer and the amount of money given to the treasurer
  • FOIA #4 – response was provided to requester: 
    • requesting all email addressed used for Shelby County Department Heads and elected officials including the dive team
  • FOIA #5 – no response provided to requester:
    • all run reports (call reports or dispatch reports) for the month of July 2024

    Key word…….again! Where is legal counsel? Why is the state’s attorney not telling these board members and department heads to comply with the requests?

    Looks like Shelby County is only 2nd to Cook County as being the most corrupt county, but that is questionable as it is a toss up.
