Judge Freezes Funds In Village Of Dolton Bank Account –

Update on the Citation to Discover Assets filed last month:

A hearing was held last week and the Court froze $440,000 in the Village of Dolton’s bank account, which is twice the amount of the judgment against them, plus interest, because the check was never tendered after the village board voted to pay it.

We assume there will be a seizure order forthcoming, which will be served on the bank who will have no choice but to tender the amount of judgment plus interest to the prevailing plaintiff.

This is the Graham v Dolton case in Cook County (17L9898), where Graham alleged the Village of Dolton engaged in Retaliation of the Whistleblower, Violation of the Public Employee Disability Act, Violation of the Illinois Wage Payment and Collection Act against Dolton and Robert Collins Jr., and Attorney Fees in Wage Payment.

A Motion for Citation to Discover Assets has been filed against the Village of Dolton for their nonpayment of a Judgment against Dolton in the amount of $220,194.56.

This is the Graham v Dolton case in Cook County (17L9898), where Graham alleged the Village of Dolton engaged in Retaliation of the Whistleblower, Violation of the Public Employee Disability Act, Violation of the Illinois Wage Payment and Collection Act against Dolton and Robert Collins Jr., and Attorney Fees in Wage Payment.

In 2019, the village of Dolton and Graham entered into a settlement, with the court retaining jurisdiction for awarding of attorney fees. The court granted $100,000 in attorney fees. The village appealed, and the Appellate Court remanded it back to Cook County Circuit Court.

On or about February 28, 2024, the circuit court entered an Order granting an award to Graham of $203,018.00 in attorney fees and $13,147.16 in costs.

Since then, the village has failed to tender the payment pursuant to this order and is now faced with a Citation to Discover Assets, which could freeze the village’s bank accounts in an amount three times the amount of the judgment until this judgment is paid, presumably with interest.

    I grew up in Dolton in the 70’s and 80’s. It was a nice little town until Shaw got his claws on it.
    Tiffers is just trying to finish what they started, for the sake of what, money? Power?

    This doesn’t even rise to the level of a Scooby Doo mystery.
