Owen Costanza‘s loser appeal to the Appellate Court was unanimously determined to be a loser by the court.
HELD: “The trial court’s judgment is affirmed because plaintiffs failed to establish the court erred in granting defendants’ motion for summary judgment.”
The statements contained on the flyer in question are factual in nature and substantially true; “…Costanza does have a misdemeanor criminal record and has engaged in fraud, as that term is generally understood, in his work as an insurance professional. To the extent that the meaning of the headings on the flyer are open to differing subjective interpretations, they are no more than assertions of opinion, not defamatory facts applicable to the plaintiff. ”
Owen Costanza has not been the President of the Village of Poplar Grove for years; however, he is still passing himself off as the Village President on his Facebook account much like a child throwing a tantrum. He needs to face the fact he is no longer the village president and change the name of his Facebook account to “former” or “Candidate for” if he is thinking of running for that office again, or maybe even “Trustee” since that is the office he currently holds.
Costanza might want to review 720 ILCS 5/17-2(b)(2).
