AG: DuPage Township violated the Open Meetings Act –

DuPage Township, IL. (ECWd) –

Today, the Illinois Attorney General’s Public Access Counselor issued a determination stating that the DuPage Township Board violated the Open Meetings Act during its February 15, 2019 Closed Session Meeting.

In it’s determination, the AG-PAC stated the following:

  • DuPage Township did not violate Section 2(c)(1) because the township did discuss the employment and employment related conduct of a specific employee
  • DuPage Township did violate Section 2(c)(3) because certain portions of the lengthy discussion strayed beyond the scope of section 2(c)(3). For example, a particular policy and a conflict between two individuals were permissibly discussed in the context of the candidate’s interpersonal skills, but at times, the discussion veered into the source of the underlying conflict and the content of specific communications. Those portions of the discussion involved the conflict itself and did not concern whether to select the candidate. . . those portions of the discussion did not substantially comply with the OMA.

To remedy these violations, this office [AG] requests that the Board review the closed session recording and vote to release the discrete portions that do not directly concern the selection of a person to fill a public office or the employment of a specific employee.

We look forward to hearing the audio of the unauthorized discussions.

    And there will be no consequences. This is the problem. These people get a hand slap instead of facing fines or jail time. Violation of the open meetings act is a CLASS 3 Misdemeanor. They need to spend some time in jail.

    This news reminded of the township meeting where Mr. Allen respectfully advised the supervisor that the meetings’ tenor was his alone, to establish and maintain. However, gaveling two certain trustees at anytime, let alone in a closed session, appears to be near impossible for anybody. There ya are, DuPage Township.

    Liberals are ideologically driven and have no love for the law. They are unconcerned with whether their desires for government action are legal. Their basis for what is right or wrong is how strongly they ‘feel’ about it. If they think something ought to be this way or that, then they don’t care what the Constitution says or the reasons it was written that way.
