US Supreme Court Upholds Freedom of Religion Clause – “Government is not free to disregard the First Amendment in times of crisis.” –

By Kirk Allen & John Kraft

On November 26, 2020

United States (ECWd) –

In a 5:4 ruling, the US Supreme Court has upheld the Freedom of Religion Clause in our Constitution.

“Government is not free to disregard the First Amendment in times of crisis. At a minimum, that Amendment prohibits government officials from treating religious exercises worse than comparable secular activities, unless they are pursuing a compelling interest and using the least restrictive means available. See Church of Lukumi Babalu Aye, Inc. v. Hialeah, 508 U. S. 520, 546 (1993). Yet recently, during the COVID pandemic, certain States seem to have ignored these long-settled principles”. –JUSTICE GORSUCH

We encourage everyone to read the entire document as it contains some very telling information regarding our rights and how certain states and even Supreme Court Justices appear to have no clue of the importance of our Constitution and its proper application.

For example:

“In recent months, certain other Governors have issued similar edicts. At the flick of a pen, they have asserted the right to privilege restaurants, marijuana dispensaries, and casinos over churches, mosques, and temples.”

“Indeed, the Governor is remarkably frank about this: In his judgment laundry and liquor, travel and tools, are all “essential” while traditional religious exercises are not. That is exactly the kind of discrimination the FirstAmendment forbids.”

“Why have some mistaken this Court’s modest decision in Jacobson for a towering authority that overshadows the Constitution during a pandemic? In the end, I can only surmise that much of the answer lies in a particular judicial impulse to stay out of the way in times of crisis. But if that impulse may be understandable or even admirable in other circumstances, we may not shelter in place when the Constitution is under attack. Things never go well when we do.”

“It is time—past time—to make plain that, while the pandemic poses many grave challenges, there is no world in which the Constitution tolerates color-coded executive edicts that reopen liquor stores and bike shops but shutter churches, synagogues, and mosques.”

    This slob sounds dangerous…

    https://pjmedia.com/news-and-politics/rick-moran/2020/05/22/il-governor-pritzker-threatens-local-police-who-dont-enforce-his-edicts-n419040

He cannot control his mouth and diet, so he’s like total fascist about enforcing his diktats. He uses the police to threaten, then threatens the police!

A scary, dangerous incompetent (and likely diabetic!) sad excuse for a governor. Siccing police on churches??? A monster!

Illinois needs to run this buffoon out of State. Maybe to Florida? Just far from here!

I believe as a precaution I would have people attending these church, temple services sign a waiver. I belong to several org. who have started that. If they (people) are willing to go to church, they should be willing to sign a waiver. This has nothing to do with freedom of religion this is a public health issue. I assume the churches don’t require shirt & shoes to attend.

      No waiver needed, nor required.

What’s with the constant pipe dream of having people sign this and sign that? What kind of society are you leftist wanting to turn America into? Have you no clue as to what that sort of society has done to many cultures and countries? Over many decades, there are millions of people from those same society of which you’re dreaming that have chosen to flee to America just so they don’t have to get approval for public gathering or personal movement, especially for a religious event.

That stupid argument of “no shirt, no shoes” is always flawed, but that’s all you got.

By the way, where I came from – a communist utopia which you leftist would love and should consider moving to – people attended church services whenever or however they could, despite the strict rules of their atheist leaders. Many folks had no shoes, and shirts were just a social courtesy, not a rule of which to bar entry. That’s what equity in poverty does to citizens of commie sh!thole.

The term “stupid Americans” are often used by the folks from communist countries who have made free America home to describe precisely folks like you. It’s definitely a torture of which we all wish somehow it could be unleashed on your kind, just so you can wake up and thank God you were born and live in America.

After surviving that commie cancer, no diseases, and especially not this over-hyped CCP virus, can scare us survivors.

Get a clue in life. Learn world history. And just a safe hedging bet, thank God you’re in America!

Constitution and Bill of Rights exist for well-thought out reasons and the court is correct.our rights have been quickly, relentlessly, and viciously attacked by govs. Wo lie, deceice, manipulate, threaten, hide the truth, propagandize, and disrespect us on the most basic, human level. The cycle threshold used to confirm +covd is too high according to epidemiologists, researchers, labtechsvirologists.Huge powergrab by elected and nonelected alike.Best practices would be Transparently communicated to public so We can decide on our behavior. Worshippers should spread out, preferably outside, use zoom/t.v. Services, have more frequent but smaller gatherings.Obviously, atrisk people should take precautions.

Who was in on the SC that said “there are no Obama justices, there are no Bush justices?” Whoever that was, he implied, or wanted to lull Americans into thinking that the SC is apolitical.

I think it was Roberts (??)

The fact that there are 4 (!!) who don’t interpret the Constitution as it should be, should confirm that there are no impartial liberals. It’s only by the grace of God that Trump was able to nominate 3 (!!) to save the Constitution.

    Thank God for that !!!!

Exactly Dave. Who are these four un-American idiots who’ve even lost first principles?! Aw.. we know.
God help this borderline commie Court when similar challenges get there.

IT’S FRIGHTENING AND DESPICABLE THAT THE VOTE WAS 5-4. EVERYONE SHOULD KNOW THE BILL OF RIGHTS ARE IN PLACE TO PREVENT GOVT ABUSES OF OUR RIGHTS AND TO HANDCUFF THE GOVT WHERE OUR RIGHTS ARE CONCERNED.

GOVERNMENT NEVER HAS THE LAWFUL AUTHORITY TO SUSPEND THE US CONSTITUTION’S BILL OF RIGHTS NOR ANY STATE CONSTITUTION’S BILL (DECLARATION) OF RIGHTS
