Algonquin Township Road District – Bob Miller Deposition – “I Don’t Remember”, I Don’t Recall”

Former Algonquin Township Road Commissioner Bob Miller was deposed earlier in the month regarding a lawsuit against him for unauthorized payments to himself and other matters.

The theme of the deposition was one of “I don’t remember, or I don’t Recall” to most of the questions presented. There were answers however that point to a direct conflict with responses in other court pleadings, claims by the State’s Attorney’s exoneration document, and responses from public bodies to Freedom of Information Act requests.

Donated Salt conflicts:

  • State’s Attorney exoneration document confirms the salt donated was owned by Algonquin Township Road District. (See page 45-47 of the report)
  • Bob Miller answer to interrogatories claims the donated salt was not the Road District’s salt but rather it was surplus salt donated by Municipalities in the County (see the answer to question #20 of the interrogatories)
  • Bob Miller’s deposition answer was he is not aware of any municipality that donated salt to the Township (See page 8, lines 11-16 of the deposition transcript)
  • Responses from every municipality in McHenry County confirms NONE of them ever provided surplus salt to Algonquin Township Road District.

Considering every municipality responded to our FOIA with the same denial of ever declaring any salt as surplus as well as having ever donated any salt to the Road District, it appears Miller’s answer in his interrogatories were not true.

Another revelation was that numerous reimbursements were made to the Road District when unauthorized purchases were made with the Road District credit card, according to Miller, however, one of our first FOIA requests for all reimbursements resulted in zero records.  Both can’t be true.

We urge everyone to read the entire transcript from the deposition to grasp the memory loss of Bob Miller.  The sad part of all of this is interrogatories, the deposition, and the facts all point to the use of public funds in violation of our laws, yet the McHenry County State’s Attorney did nothing to hold Miller accountable.

We understand the next filing will be a Summary Judgement Motion on the facts which will include seeking the recovery of the $47,381.84 Miller paid himself the last few days of his term.  We suspect that motion will be granted.

    He has been following to many politicians in Washington with that many lame excuses. Sounds just like Washington politicians.

    What a hoot! Algonquin’s finest fiefdom and McHenry County’s own, the Miller road clan. The mailbox thing reads like a scam worth certifying, counselor.

    Algonquin Township Highway Commissioner Andrew Gasser took the stand earlier this month to face a contempt charge, and his memory failed him.

    In more than 10 instances during that Jan. 10 hearing at the Lake County Courthouse, the road commissioner fielded questions of the labor lawyer cross-examining him with responses like this:

    “I don’t remember.”
