Will Co. (ECWd) –
Joliet Township is once again facing another lawsuit stemming from their refusal to follow the law. A complaint for Writ of Mandamus and Mandatory Injunctive Relief has been filed in the Will County Circuit Court.
“However, Joliet Township’s Clerk refuses to place the budget on the agenda for mandatory board action. Moreover, the Joliet Township Board refuses to act on the budget of the ROAD DISTRICT.”
As it pertains to the Joliet Township Road District budget, the law is crystal clear.
“It shall be the duty of the clerk of the road district to arrange for the public hearing. The township board of trustees or highway board of trustees, as the case may be, at the public hearing shall adopt the tentative budget and appropriation ordinance, or any part as the board of trustees deem necessary.”
The prayer for relief seeks three simple things but we suspect the Township Supervisor Dan Vera will fight the lawsuit as it’s become clear Vera has no interest in following Township laws as evident from past articles.
The Road District is seeking:
A. Issue a writ of mandamus compelling and ordering Defendant, JOLIET TOWNSHIP, to take the mandatory action to approve Joliet Township Road District’s budget:
B. Enter a preliminary mandatory injunction commanding Defendant, JOLIET TOWNSHIP, to approve Joliet Township Road District’s budget; and
C. For any such further relief as this Court deems equitable and just.
