John Norton lies to the Court once again in bogus Emergency Motion to vacate order of protection against him.

John Norton, former appointed Wesley Township Highway Commissioner was issued a Restraining Order last October and is now attempting to have it vacated through a bogus Emergency Motion.  There is no emergency.

Contained within his motion to the court are several lies, which appears to be the pattern with Norton as exposed in this article.

  • “That Officer Jose Campos was placed on administrative leave in which to preclude him from testifying in Open Court and Bench Trial, to preclude his written report from being entered into the record as evidence, and also to deny and suppress the Respondents Motion of Discovery;”

We attended the trial against Norton and the above statement is not true.  The Prosecutor for Wilmington stated the Officer was on vacation.  Nevermind the fact being placed on administrative leave would not preclude a person from testifying.  Nor would it preclude his written report from being entered into the record.  If Norton truly wanted him present all he had to do was subpoena him, which he did not do.

  • “That the Petitioner, by her own admission, in Open Court, did state under cross examination that she intentionally followed the Respondent to various locations, on September 20, 2020, and again on May 12, 2020, for the purposes of taking pictures of the Respondent;”

False!  The Petitioner in that trial was the City of Willmington, not an individual.  The person questioned in that case said nothing about “intentionally” following Norton for the purpose of taking pictures of him.  What was stated is she took pictures of him.  That was where the Willington prosecutor failed as a prosecutor as he never asked the question as to why she was taking those pictures.  We did ask and were told it was to prove Norton continues to violate the TRO against the person.

  • “That witness Spinale also testified that he observed others from both the Edgar County Watchdogs, a 501(c)4 organization, and various members of the Wesley Township Citizens Facebook Group conducting similar actions, on various dates and times, over a two (2) year period;”

False!  Spinale said he “believed” it was Kirk Allen who was taking pictures.  The fact of the matter is that Spinale could have never seen me taking pictures of him and Norton as described in court because it never happened.   This was nothing more than former Wesley Township Trustee Spinale coming to his employee’s defense as he did in the original TRO case that Norton lost.

  •   “That after the Trial on June 15, 2020, the Petitioner, along with others, waited in the parking lot of the Wilmington City Hall Annex Court for the Respondent Norton to exit the building;”

False!  The people in the parking lot were not waiting for Norton to exit.  They were simply talking to one another about the events of the trial that took several hours.  Those same people were still in the same parking lot for at least 10 minutes after Norton left.

  • “That the Respondent was escorted to his vehicle by a Will County Sheriffs Deputy as the Petitioner and others attempted to taunt and harass the Respondent;”

False!  No one attempted to taunt and harass Norton.  We challenge him to subpoena the Deputy to his TRO hearing and put him under oath on this issue.

Norton’s initial hearing was continued as he failed to properly notify the opposing party.  The new hearing is set for June 29th, 2020. We predict he will lose in his attempt to vacate his restraining order and end up having to pay a substantial figure in legal bills of the person who obtained the original restraining order.
