Cease and Desist sent to Illinois Gaming Board re: Poopy’s Pub and Grub –

By John Kraft & Kirk Allen

On June 3, 2020

CHICAGO, IL. (ECWd) –

Mr. Marcus D. Fruchter, Illinois Gaming Board was sent a Cease and Desist letter from Thomas DeVore, attorney for “Poopy’s Pub and Grub” in response to a “Warning Notice” (see page 3 of the letter) sent to the business.

The Cease and Desists asks the Illinois Gaming Board to never contact the business again regarding any matter regarding its operations as it might relate to public health.

Poopy’s received a Cease and Desist Order on May 6, 2020 from the Illinois Liquor Control Commission, and now received this Warning Notice from the Illinois Gaming Board on May 29, 2020. Poopy’s remains open for business.

From the letter:

  • with all the tactics of intimidation I have witnessed in the last couple of months regarding against the good people of this state, your actions against my client are by far the most egregious. The Illinois Gaming Board should be ashamed!
  • At no time relevant were any gaming machines ever in operation…”and I can’t possibly imagine why you would be threatening his licensure
  • Unless your agency has recently been anointed pontif over public health matters, we find no purpose for your correspondence other than to be another “tool” of intimidation being wielded against the small busineses of Illinois by the executive branch.
  • our client thanks your agency for its correspondence and respectfully declines to take any action relative thereto, but rather chooses to exercise the liberties and freedoms given to them by God and guaranteed by law
