Pritzker hit with Restraining Order motion yesterday – IDPH withdraws their illegal rule today!

Illinois (ECWd) –

James and Kali Mainer and HCL Deluc Tan, LLC. filed a motion for a Restraining Order against Governor Pritzker’s rule change through IDPH making it a crime for certain business to open their doors. We covered that very rule change in this article.

According to the motion, which we agree with, the rule “Amendment mandates a sweeping substantive legal change by denying certain procedural and substantive safeguards previously enacted by the legislature in the Illinois Department of Public Health Act. (20 ILCS 2305/2(c).  In enacting the Amendment, the Department has exceeded its authority under the Illinois Department of Public Health Act in violation of the Illinois Administrative Procedure Act.”

After hours of delay in the scheduled JCAR meeting to address this illegal rule change, IDPH withdrew their rule!

Considering the rule has now been withdrawn, the Motion for the TRO will be withdrawn from the courts according to Tom DeVore, the downstate attorney who is instrumental in waking up an entire state of lawyers who are also filing actions against the Governor.

This is a good day in Illinois!

    A big thanks to the ECWD for all their efforts to keep government in check. You may not have heard all the jumping up an down and clapping but it was happening. A big bright spot in these gloomy days of COVID-19. Thanks again!

    This is why we have 3 branches of government. Two of them are clearly not working in IL right now, but the judicial branch is doing its best to hold it together for us. Need more attorneys like Tom DeVore!
