Shelby County – Someone needs to resign or be fired!

Shelby Co. (ECWd) –

There comes a point when enough is enough and terminations or resignations are in order.

While Shelby County board and legal counsel have taken the position that attorney Ed Flynn is a “Special Assistant State’s Attorney“, we need to point out some key facts that are clearly problematic.

  • At the time the County Board hired Ed Flynn, they hired him to deal with Labor negotiations for the 2014-2015 budget matters.
  • There is no provision in the law for a County Board to hire a private attorney
  • There was no oath of office taken
  • The expenditure for his work is being paid out of County General fund rather than the State’s Attorney’s budget
  • He is the ONLY person hired in the original resolution.

With all that in consideration, can anyone explain the following?

  • How, out of $1,563.25 worth of billing on one invoice, only $46.25 of the bill has anything to do with the intended purpose of his hiring?
  • When were two other attorneys authorized to do work for the county? 
  • Why is outside counsel doing work and billing the county for work that has nothing to do with labor negotiations?

And probably the most amazing point with this billing is the very first item.

Research FOIA requirements to determine if request by Treasurer to police department is valid and enforceable.”

Seriously? 

Someone in Shelby County asked for legal input as to if an FOIA request from the Treasurer to the police department is valid and enforceable?

Any FOIA submitted to any public body is valid and enforceable within the established exemptions outlined in the FOI Act.  

It took me about 15 seconds to type out that sentence so why on earth would it take a lawyer, or whoever this “never hired by the county person is“, 30 minutes to figure out the law?

Whoever requested this work to be done should be terminated and if they are an elected official they should resign immediately.

At no time did the law permit the county to take the action they did and even if it did, their action said nothing about having other people do the work and have it billed to the county.

So in Shelby County, only $46.25 of a $1,563.25 invoice was even for the very work the attorney was hired to do.  This is straight-up abuse of the taxpayer and it must stop.
