Belleville, IL. (ECWd) –
In a February 28, 2020 determination letter, the Attorney General’s Public Access Counselor determined that the City of Belleville did not sustain its burden of demonstrating that certain information it redacted from a crash report responsive to a FOIA request is exempt from disclosure.
Belleville redacted names of witnesses (including the drivers) of a traffic accident report, which the PAC determined were improper redactions.
This determination also concluded that Belleville improperly redacted the business name of the owner of a vehicle involved in the accident, as well as the address and phone number of the business, the commercial license plate number and insurance information, and the make and VIN number for the business vehicle – stating that business information is not personal and not subject to redaction.
The PAC directed Bellville to provide the redacted information.
