McHenry Co. (ECWd) –
Algonquin Road District attorney Rob Hanlon filed an Amended Complaint against Charles Lutzow regarding his handling of Road District funds. It appears there are distinct differences in this amended complaint vs. the original complaint that was dismissed without prejudice.
It now outlines the funds of the Road District were not only not in the name of the Road District, but that those funds were actually deposited into the Township’s name, a separate unit of government.
It also outlines the harm caused by the action Lutzow took.
- Road District was denied the use of its funds to satisfy the judgment granted against it.
- Additional judgments have been granted against the Road District and a possibility exists that additional judgments could enter against the Road District.
- As a direct and proximate cause of the breach of the fiduciary duty detailed above, the ROAD DISTRICT suffered an injury in that its funds are no longer in the name of the ROAD DISTRICT and that it was not able to satisfy a judgment taken against it.
We believe Lutzow has 30 days to answer the amended complaint. We will update the article when that answer is provided.
