Algonquin Township being sued for actions taken beyond their authority

McHenry Co. (ECWd) –

Is there anyone that does not understand that one public body cannot pass resolutions and policies for another public body?

It would do the Algonquin Township Board well to find new legal counsel and begin following their own laws and stop trying to manage the Road District.

It would appear their actions have placed them once again in the middle of more litigation, but of course, they will blame the Highway Commissioner Andrew Gasser for enforcing the laws on the books. We understand that is a new concept to some of these folks.  They may want to get used to it.

The Road District filed a VERIFIED COMPLAINT FOR PRELIMINARY INJUNCTION, MANDAMUS, DECLARATORY JUDGMENT AND OTHER RELIEF today in the McHenry County Circuit Court.

Named as defendants are the Township Supervisor Charles Lutzow, Township Board Members Melisa Victor, Dan Shea, and Dave Chapman. We understand that Racheal Lawrence was not named as a defendant as she voted against the actions taken by the board in their efforts to place controls on the Road District, a separate public body.
