College of DuPage- voting to settle claimed excess force and false arrest by Police

DuPage Co.  (ECWd) –

November 4th, 2015, Plaintiff  Jaclyn Pazera filed this complaint against police officers working for the College of DuPage and also named the college.

November 13th, 2015 Plaintiff filed an amended complaint.

January 6th of 2016 the College filed their answer to the complaint.

March 2nd, 2017, the parties declined the Judge Magistrate’s settlement recommendation.

May 3, 2017, Plaintiff Counsel fails to appear.

Todays COD Board packet contains the settlement agreement that is to be voted on during their next meeting, which is a Board Retreat meeting to be held May 7th, 2015.  It appears something significant happened between the time the Plaintiff’s attorney failed to appear on May 3rd, two days ago, and today, May 5th.  A copy of the proposed agreement can be viewed below.

“PLAINTIFF understands that this settlement is entered into for the purpose of avoiding the expense and burden of further litigation and that this settlement is not to be, and shall not be, construed as an admission or indication whatsoever of liability or wrongdoing on the part of any party hereby released.”
