DuPage Co. (ECWd) –
Federal Judge Wood issued an order May 5th, 2017, regarding the appeal requested by the College of Dupage and the Board members named in the case. The order was granted which puts a stay in place on all proceedings pending the appeal.
“Defendants Bernstein, Hamilton, Mazzochi, and Napolitano’s motion t0 stay all proceedings pending appeal [104] and Defendant Board of Trustees of Community College District No. 502, DuPage County, Illinois’s (“Board”) motion to certify for interlocutory appeal [106] are granted.”
In addition, the Judge denied Breuder’s claim that their request for appeal was frivolous as well as denying their motion to strike the exhibits and certain portions of the COD reply.
“Plaintiff’s cross-motion to certify Defendants Bernstein, Hamilton, Mazzochi, and Napolitano’s appeal as frivolous [117] is denied. Plaintiff’s motion to strike the exhibits to and certain portions of the College of DuPage’s reply [125] is denied as moot. See accompanying Statement for details.”
We suspect this step will lead to a dismissal of key parts of the Breuder lawsuit.
