CARLINVILLE, IL. (ECWd) –
The Illinois Attorney General has sent the City of Carlinville letters of inquiry in response to several requests for review of alleged Freedom of Information Act violations that I forwarded to the AG’s Public Access Counselor (“PAC”).
These letters require the public body to respond to the AG within 7 business days to explain their position on my allegations. This requirement is found in Section 9.5 (c) of the Freedom of Information Act [5 ILCS 140]. It is well beyond the 7-day mandatory response time.
The AG has the power to issue a subpoenas for the information when a public body fails to respond.
Additionally, the city of Carlinville city council at its last meeting, directed the attorney to provide the requested records for all FOIA requests submitted prior to that date, and for him to provide those records by Friday, April 7, 2017. Today is April 13, 2017, and no records have been provided.
Carlinville’s attorney handling these requests should be instructed to pack his bags and hit the road…unless Mayor Demuzio has told him to continue stalling…??
