Clark County Park District sued for failing to provide public records…again –

MARSHALL, IL. (ECWd) –

Another lawsuit has been filed naming the Clark County Park District (“CCPD”) as Defendants for another in a long line of failures of their Executive Director, Charity Murphy.

Murphy has consistently failed miserably when it comes to the requirement to provide public records in a timely fashion. The law is simple: provide the records.

Lisa Thomas served a Freedom Of Information Act Request for public records on the CCPD on May 26, 2016 seeking public records. The response was due, according to law, by June 3, 2016. As of June 20, 2016, a full 17 days after state law requires responses, the requested records had not been received.

The Three-Count Complaint for Declaratory Judgment and Injunctive Relief alleges violations of Sections 3(e) for failure to properly extend the time for response, Section 9(a) for failure to provide proper notification of denial, and Section 3(d) for not providing the public records as state law requires.

Thomas is seeking a declaration of willful and intentional violation of the FOIA law, production of the records, civil penalties of between $2500 and $5000 per occurrence, and court costs and fees.

Murphy has caused numerous lawsuits over access to public records, and was rewarded for all her “hard work” with a hefty pay-raise by Ron Stone, Glen Kuehnel, Joe Ewing (participant in election fraud), and Terry Stepp – maybe she intentionally does this to get another pay raise?

She also claims to have a “lease agreement” at a house she has never lived in, which she thinks qualifies her as being a resident of the district even though she still lives in West Terre Haute, has previously been involved in failing to pay for electricity, and park district boat dock brawls (along with her husband), participating in election frauds, and should get an award for being the one person in this State to violate FOIA nearly every time a request is sent.

    It’s gonna take the state’s attorney or a circuit court judge with the anatomy to put an end to Murphy and Park Board’s garbage.
