Tip on another possible FOIA lawsuit headed towards Clark County Park District –

By John Kraft & Kirk Allen

On June 16, 2015

Clark Co., IL. (ECWd) –

We have received a tip from someone in another part of the state that Charity Murphy has failed to respond to a Freedom Of Information Act request.

They are wanting to file a lawsuit to force disclosure of whatever financial information they had requested.

I am finding it very difficult to say anything other than “sue them” since I know FOIA violations are running rampant within Charity Murphy’s office – and have been for some time.

The problem is that the taxpayers end up footing the bill for the Park District Director’s failure to do her statutorily mandated and non-discretionary duty – and the majority of the board are too spineless to do anything about it (they know who they are).

“The FOIA”

On Thursday, June 04, 2015 @ 3:06 PM, someone sent a FOIA request to Charity Murphy at her Park District’s email address.

Since June 4 was a business day and it was received prior to the close of business, June 5 is day one of the five business day time frame to respond.

Today is June 16 – eight days after the request was sent and received.

Charity Murphy has once again placed the Park District in jeopardy of another lawsuit due to her own (in)actions.

I will publish the original FOIA request after I receive permission from the sender that it is OK to publish – or when I get my own copy thru FOIA.

I think the whole things boils down to either the Director is “over their head” as far as the job goes, doesn’t give staff proper direction or just thinks that they (their office) is above the law. I think the situation is unfortunate for the park district and area.
