Coles County Board and Bob Becker Named in Multi Count Civil Suit Seeking Declaratory Judgment

Coles Co. (ECWd) –

A multi-count lawsuit was filed today in Coles County by Charles Lee Stodden’s attorney, Thomas DeVore.

The lawsuit is seeking a declaratory judgment regarding the County Board’s hiring of a private contractor to perform commercial assessments and for providing compensation of health insurance to three board members in contradiction to the compensation set by the County Board.

Board members Stan Metzger, Darrel Cox, and Rick Shook all are receiving health insurance which was never authorized in the board-approved compensation for County Board members.

The suit is seeking the following:

A) Declaring that Coles County Board Members shall be compensated in amounts only as authorized under the Compensation Resolution passed May 08, 2012;
B) Declaring payments to Coles County Board Members to defray their health insurance premiums is compensation;
C) Declaring any payments of compensation in excess of amounts authorized by the Compensation Resolution unlawful;
D) Awarding Plaintiffs their costs incurred in this matter as may be allowed by law;
E) Granting such other and further relief as is just and proper.

    At least Coles County, Illinois’ southwest neighbor has the office of the state’s attorney represented during board meetings and such…better than last year, anyway. For certain though, the Coles County web-site reads like the Board’s standing committee on County Office/Rules is out of touch with state law.
