Quincy Public School School Board Named in Declaratory Judgement / Permanent Injunction Lawsuit –

Quincy, Illinois (ECWd) –

The Quincy Public School Board has been named in a verified complaint brought by a parent of one of a 4th-grade student.  The suit was filed over the mandates created for children to return to school.

“Quinn, and her minor child, will suffer irreparable injuries based on the implementation of the Mandates because the Mandates infringe on the minor child’s right to an in-person education within the public school free from these unlawful general mandates which are tantamount to law and which were not promulgated by the legislature.”

Anyone willing to truly grasp the importance of this case should take the time to read the case law provided in the Memorandum in Support of the filing.  We took the liberty of highlighting some of the key points in those cases.  While we understand the numerous health concerns being raised across this state relating to COVID-19, we ask that those concerns be properly placed within the rule of law.  This case highlights the importance of following the laws passed by the Legislature rather than allowing public bodies or State Agencies to create their own laws as they deem fit, which is what appears to be taking place currently with schools throughout the state.

The hearing for Preliminary Injunction is scheduled to be heard next week, July 16th, 2020 in the Adams County seat, Quincy, Illinois.

    Ok, I take issue with the “China Virus”. That’s political thing. Just say the Covid-19 Virus – pls stop putting your political party spin/views. As far as what the school is trying to do — keep kids safe in a difficult setting. If that parent doesn’t like it why not home school, or if some private school isn’t doing anything go there. I would rather have my kid have their temperature taken & yeah, having the mask thing is a drag & the other – but I want my kids and the teachers safe, No one says I have to have my kid attend public school, there is home schooling/private schools.

      Regarding keeping kids safe, please see the death rate in the 0 – 24 age group. While kids aren’t dying of covid, they are going to suffer great harm from these school mandates. Data from Spring’s e-learning proves it. And actually, a free public education IS my children’s right. Unless you’d like to gift me the $15,000+ it costs to send my 3 to private school for the year? Or homeschool them for me? Lord knows I’m already paying enough in property taxes to the public schools.

      Masks do NOT, I repeat do NOT, prevent the spread of this virus. They DO restrict breathing, cause anxiety, and influence people to touch their faces more often than normal which can make the virus MORE likely to spread.

      Jannie, I take issue with you calling it the “Covid-19 Virus.” That’s a political thing. Just say China Virus – it’s where the virus started, just like Spanish flu, West Nile virus, Middle East Respiratory Syndrome, Zika and Ebola – pls stop putting YOUR political party spin/views on us. As far as no masks in schools, if a parent doesn’t like it, why not home school? Or if some private school is doing masks, go there? My children are not here to assuage your unfounded fears or validate your irrational hysteria. No one says you have to have your child attend public school! Feel free to home/school or use private schools.

    Good Luck in the 8th circuit. Locally it is know to be very political and the judges easily ignore case law.

    Our schools were AWOL during H1N1 – far more children were getting sick and dying from H1N1 than from COVID. Our schools did very little nor showed very little concern over H1N1. Over 60 million people contracted the illness and over 12,000 people died. With COVID, we are hearing “If we can just save one life”. Where was the CDC, WHO and our local governments? Why was there no concern for people getting ill or dying from H1Ni? Why were we not wearing masks, or social distancing? Same with EBOLA and SARS. This will prove to be, when all is said and done – very political.. The Democrats want to keep the fear going until November.

    I also think “China virus” is political and childish name calling. What is next? Will she sue our doctors and hospital because they require temperature and mask? What a waste of money and time. Our schools and teachers deserve our support. Safety should be first and foremost on our minds. The school is trying to accomplish this in a very tough situation.

    Rita What point are you trying to make? No one is bashing teachers. Its about the rule of law and the constitution. As far as the “schools” its easy to just say we are following what we are being told to do. I don’t see that as making a tough call. .

    I posted this before, but what a better forum than talking about safety for children, there has been exactly one study regarding cloth face masks. This study shows that masks are not only bad, but also are ineffective. They were shown to prevent the spread of disease by about 3% and made the wearers much more likely to come down with an upper respiratory infection, sinus infection or pneumonia… In COVID studies kids are highly unlikely to contract the disease and even less likely to transmit the disease. What should be the concern is teachers transmitting between each other, not the kids…
