Darren Bailey law suit against Gov Pritzker remanded back to State Court –

Clay Co. , IL. (ECWd) –

The UNITED STATES DISTRICT COURT SOUTHERN DISTRICT OF ILLINOIS has issued their order and it is not good for Governor Pritzker as all indications point to him as a loser in the State Circuit Court.

“For the above-stated reasons, Plaintiff’s emergency motion to remand (Doc. 7) is GRANTED. It is hereby ORDERED that, pursuant to 28 U.S.C. § 1447(c), this action be REMANDED to the Circuit Court for the Fourth Judicial Circuit, Clay County, Illinois. No fees or costs are awarded. The Clerk of Court is DIRECTED to transmit a certified copy of this Order to the clerk of the state court, and thereafter to CLOSE this case.”

We encourage everyone to take the time to read the ruling from the Federal Court to grasp why the Governor and the Attorney General were wrong in their efforts to delay justice in the State Circuit Court.

We anticipate Tom DeVore will be coordinating a hearing date first thing in the morning.

    That is not what the federal court concluded. Read the opinion.

      Yes, the judge declined to make Pritzker cover Bailey’s fees related to the removal of the case to federal court because he did say Pritzker was justified in trying to have the case moved. Not sure I agree, though. The fact that they wanted until the day before the case was to be heard in Clay County to move it seems fishy. The judge took 5 weeks to decide if it went back to Clay County, he had to have reason for taking so long. (Or, in my opinion, stalling so long.) Seems pretty straightforward to me, the entire case is centered on the Illinois emergency management agency act which is part of the ILLINOIS constitution, not federal. I’m not an attorney, though!

    Well, so far it’s been fun. Taxpayer dollars continue to be dumped into the landfill known as the Governor’s emergency China virus project:: in defense of same…
    Our Attorney General and his cronies operate without scruples in deference to our public health laws. Out state is bankrupt and no one cares.
    Meanwhile,, the reckless spending of taxpayer monies and government resources isn’t a problem for our governor or public officials. Taxes are going up and citizens that cannot stand this any longer, just leave Illinois. Those remaining will be taxed to death.

    The State of Illinois needs to leave The State of Chicago..

    I don’t see why you wouldn’t get your expenses covered, but maybe someone can coordinate a go fund me or something if JB doesn’t have to reimburse you?

    I do not understand why you are suing Pritzker, all other governors are doing the same things and haven’t heard of them being sued !!! So what the deal ??
