Illinois – URGENT call to action!

Illinois (ECWd) –

The JOINT COMMITTEE ON ADMINISTRATIVE RULES has the power to stop the Administrative Rule being proposed which would make criminals out of our state business owners.  We covered this proposed new rule in this article..

According to the JCAR agenda:

“If members of the public wish to express their views with respect to a proposed rule, they should submit written comments to the Office of the Joint Committee on Administrative Rules at the following address: Joint Committee on Administrative Rules, 700 Stratton Office Building, Springfield, Illinois 62706”.

Considering the current proposal tramples our Constitutional rights and will cause irreparable devastation to the lives of many, and further destruction of our economy, we urge people to take action and submit a written comment on these proposed rules.

Rather than mailing the submission, send them the submission by email at the following email address.

We urge everyone to read this article in its entirety to include the supporting documents to grasp the magnitude of this proposed rule and upon educating yourself on those facts, submit your written comment for their consideration.

The subject of those written submissions needs to reflect the following:

Section 690.40 Pandemic or Epidemic Respiratory Disease – Emergency Provisions EMERGENCY

We urge all who submit a written comment to be professional and factual with their submission and outline clearly and distinctivly how this propsed rule will impact themselves, local business, municipalities and the state as a whole.

Again, we urge the public to stand up and be heard on this new rule that can put business owners in jail while the Governor is letting violent criminals out of jail.

    This guy is destroying our State !! Is it revenge for the people standing up to him by saying. “NO MORE ” ?? Apparently he’s not used to being called out on his destructive orders. He’s a rich, spoiled over grown little boy used to getting his way or he will throw a tantrum !!! We the people need to show him we will stand together against him. I FOR ONE, HAVE HAD ENOUGH !!!!!

      JBP must be stopped along with his puppet Dr. Ezike who are destroying Illinois and they must be stopped. JBP is trying to make Illinois the first communist state. Illinois is being made a testing ground by JBP. There’s not a chance of him being recalled so citizens need to step up and stop him. Where is Mike Madigan? He’s usually front and center. We need to clean house and rid Illinois of everyone of these “officials” that are deliberately destroying Illinois. Kwame lying on his ethics statement needs to be prosecuted. No more report offenses and nothing be done. We have had it with the destruction to our state. #saveIllinois

      South Dakota didn’t shut down at all. They had 4 covid cases per 100,000 population.

      Doctors are now coming forward stating wearing masks, staying home, all reduces immunity. This is what JBP and other democrats want. A weakened population that will be groveling for a handout, soup lines, etc. #saveIllinois

    My daughter runs a small beauty shop. This a’lot of income to help a family of she has one chair and two dryers. This is nothing compared to going to Walmart were there are 100 people. This lock down is just plain killing down state small businesses. We need to be working to live .the hospitals aren’t even working at full staff down here .who is going to pay all of these people’s property taxes next month? They don’t have the money to pay them because they haven’t been working. This is simply let’s open the state up before it’s too late.

    Blanent over use of power! He is killing our state financially. He is putting so many families in such a tough place financially, he must not realize when parents cant work children dont eat. Instead of giving another crook 7 million dollars maybe he should be giving to the small business owners, donating to the food banks and giving back. Or even better give us our freedom back, re-open the state.

    Does the Governor still take a salary, and heath and welfare contributions made by the state? He’s worth $3 billion and doesn’t need the money. He’s bankrupt his state so maybe he intends to use his personal wealth to bail out his subjects? LOL.

    Dear Distinguished Members of the Joint Committee on Administration Rules,

    I write to you as a concerned citizen, a former public office holder, and business owner. As a concerned citizen I worry that our government officials (elected and non-elected) are exceeding their authority under statute, the Illinois Constitution and the United States Constitution. As a former public office holder, I took an oath to support the laws of the state and country. And finally, as a business owner, I fear for the arbitrary application of these rules to some businesses and not others.

    As I understand one of the roles of the Joint Committee of Administrative Rules, herein referred to as JCAR, is to ensure the Agency rules meet the requirement of the Illinois Administrative Procedure Act (IAPA) and do not exceed the authority that the General Assembly has granted to the agency in statute (ILCS). I present to you that the Proposed Emergency Rules Section 690.4 Pandemic or Epidemic Respiratory Disease are in contradiction of the statute laid out in Section 2(c) of 20 ILCS 2305 and the legislature has not changed the requirements of due process afforded to individuals and businesses laid out in it. Specifically, Section 2(c) of 20 ILCS 2305 requires that the State Department of Health, when not getting consent from the individual or business to voluntarily close, prove by clear and convincing evidence to a court of competent jurisdiction that “the public’s health and welfare are significantly endangered by a person or group of persons that has, that is suspected of having, that has been exposed to, or that is reasonably believed to have been exposed to a dangerously contagious or infectious disease…”. Furthermore, “The Department must also prove that all other reasonable means of correcting the problem have been exhausted and no less restrictive alternative exists. For purposes of this subsection, in determining whether no less restrictive alternative exists, the court shall consider evidence showing that, under the circumstances presented by the case in which an order is sought, quarantine or isolation is the measure provided for in a rule of the Department or in guidelines issued by the Centers for Disease Control and Prevention or the World Health Organization ”

    This proposed emergency rule removes the requirement in forcing a business closed under 20 ILCS 2305 2(c) that the State Department of Public Health prove to a court that the public is at risk because someone is suspected of having, has been exposed to, or is reasonably believed to be exposed to a dangerously contagious or infectious disease. It also ignores the fact that the State Department of Health has to prove that less restrictive alternatives exist.

    I believe the proposed emergency rule is also arbitrary as it only addresses businesses that have been publicly vocal about the hardships put upon them by the executive orders of the Governor and have chosen to not adhere to those orders. There is absolutely no reason why these specific businesses cannot implement their own regulations and follow guidelines of the CDC to slow the spread of the COVID-19, just like grocery stores and gas stations. Ask yourself this question. Is the virus more contagious in the environments listed in the proposed emergency rules with precautions implemented just like other business? Of course not. A virus does not know what establishment it is in.

    There is already a penalty mechanism inside of 20 ILCS 2305 in Section 8.1 that reads as folllows ” Whoever violates or refuses to obey any rule or regulation of the Department of Public Health shall be deemed guilty of a Class A misdemeanor.” . This proposed emergency rule, if adopted, actually accomplishes nothing except an attempt to strip due process rights from citizens of this state. It will create confusion and fear amongst the state’s citizens and people charged with enforcing the rule.

    I thank you for considering my thoughts on the rules, and I hope that they are considered in making the determination of whether to allow them to be adopted.

I have natural human rights and refuse to be mandated to vaccinate or isolate myself or my family from society on lack of accurate data to prove that the virus is as deadly as the media is saying it is.     I believe it to be very unfair to make a criminal out of a citizen that is just wanting to work and put food on their table. Why, if we are we still in lockdown when so many of our counties have no deaths from this virus? I was appalled to find out that our governor, Pritzker, is capitalizing on each and every citizen in the state that takes the Covid-19 test, he should divest his business during this period of time. Please do not keep us in lockdown until the November elections as some are speculating.

    I just watched “Gary Franchi is with Tom McCullaugh”. A friend sent through messenger as I don’t use Facebook.

    Gary Franchi said in his interview with Tom McCullaugh, that JBP plans to submit necessary order to the secretary of state to authorize IDPH arrest powers now that it’s been exposed that IDPH didn’t have arrest powers. Further, JBP is bypassing the legislature to enforce IDPH powers to arrest. Arrests will be made by ISP if local police and sheriff’s refuse to comply. JDP says arrests for not wearing masks or not following his orders explicitly. Class A misdemeanor. There’s more about making comments on Facebook, etc suffering consequences. Total lockdown, censorship, imprisonment.
    This has to stop. We’re tax paying citizens.

    I apologize I don’t have the link to support what I wrote. I was unable to get it to copy and paste. Regardless, Gary Franchi is reinforcing what Edgar County Watchdogs is warning us.

Governor Pritzker is unconstitutionally suppressing the rights and liberties of the residents of Illinois. Please stand up with the citizens of Illinois.     He should be focused on improving the emergency response from nursing homes, rehab facilities and urban areas. These locations had no PPE and in the urban locations people have completely ignored social distancing and shelter in place. This is proven by the continual crimes being committed. Because the State and Cook County bungled the handling and safe implementation of measures and distribution of equipment many lives were lost and Hot Spots created. The Governor and Mayor must be investigated by the DOJ also the billions of taxpayer dollars spent foolishly with a full report to the people and potential prosecution.

    It is absolutely outrageous that this is even being considered.

    This is the most blatant affront to the Constitution I have ever encountered and my Constitutional
    right cannot be suspended for the power-mad governor. Apparently his idea of an economic plan
    is “I’m a billionaire, screw you”. We were leaving Illinois anyway but this may speed up the process.
    There’s no way this idiotic and unconstitutional power grab survives a court challenge that is certain
    to follow. I can’t believe Madigan (the REAL governor) is even considering this especially when his
    long-time power base is labor unions who are ALSO out of work.

    If this goes through, brace yourselves for food riots and Chicago will become a REAL war zone instead of a wannabe war zone. Proceed at your own peril. I’m pretty sure that the founding fathers put the Second Amendment it the Constitution for the possibility of something like like this.

    There’s also no way the federal government won’t step in over this. You are not going to get a bailout from the Federal government. Most of the Illinois population lives close enough to a state line that they can cross the state line and go to their new jobs. In my area virtually everyone can drive across the bridge to Missouri to work which most have been doing for the entire time that I have resided in Illinois.

    I think it is time for everyone to contact their States Attorneys in addition to sending emails to JCAR. The States Attorneys have the authority to reign him in and indict him if necessary. They are supposed to be protecting the Constitutional Rights of the Taxpayers in their respective Counties.

      “I hope so” said the Governor in reply to the news reporter question about MLB in Chicago this year. The Governor’s reply is one of the shortest replies on record. The Governor Did Not say “I hope not” when asked about his business interests profiting from the pandemic, although both questions may have been asked during same press conference. Instead, the Governor’s usually long winded reply invoked a legal claim about his family’s business interests being held in a “blind trust.”
