Wesley Township Supervisor, Clerk, and Trustee resigned at last meeting –

WILL Co. (ECWd) – 

During last night’s Wesley Township’s Board of Trustees meeting, the Board accepted the resignations of the following positions:

  • Township Supervisor Quigley
  • Township Clerk Norton
  • Township Trustee Welchco

The first 2 are effective immediately, the third is effective at the end of this month.

Although there is a requirement in the township code for a board to accept a resignation, caselaw says otherwise. In fact, in Gates, the Court cited precedence which says a public official has a right to resign, and resignations become effective when received by the office (or board) with the power to appoint a replacement (Gates v. Town of East Eldorado, 369 NE 2d 582 – Ill: Appellate Court, 5th Dist. 1977).

The Wesley Township attorney Stewart Diamond, Equity Partner of Ancel Glink law firm was explaining the appointment process for a deputy supervisor, however, the process explained is no longer current law.  We pointed out the new change to the Township Code, which became effective about 6 weeks ago, mandating a deputy supervisor be appointed from among the remaining trustees. Diamond confirmed the changes and read the new law aloud for everyone to hear.   The temporary deputy supervisor position terminates when a permanent supervisor is appointed.

    Wow, good thing they approved their resignations….lol. I can’t imagine them trying to drag the resignees back into a meeting.
