Algonquin Township – Charles Lutzow able to sign settlement with Road District

Back in June of this year, Algonquin Township Supervisor Charles Lutzow was hospitalized for a medical condition that leads to his position as Supervisor being temporarily vacated.  His wife was appointed to perform the ministerial duties of the Supervisor’s office.

Lutzow has now signed an agreement to have Road District financial accounts properly placed under the appropriate Road District names.  An action that he simply refused to do for months which resulted in even more legal fees.

According to the Township code, “If the office is temporarily vacant, the temporarily appointed deputy may perform the ministerial functions of the vacant office until the township officer submits a written statement to the appropriate board that he or she is able to resume his or her duties. The statement shall be sworn to before an officer authorized to administer oaths in this State.”

We understand that to date there is no such written statement from Lutzow to the Township board.  That being the case, how is it that Lutzow is able to settle personal legal matters a month ago brought against him by the Road District but unable to perform his duties as Supervisor?

While we are pleased to see the matter of Road District accounts getting resolved, this resolution raises more questions regarding Lutzow’s ability to resume his elected duties.  One would think if you’re able to navigate a legal settlement and sign it in your personal capacity then you would think he is able to resume his elected duties.
