Algonquin Township – McHenry County State’s Attorney Kenneally closes door on criminal prosecutions

McHenry Co. (ECWd) –

McHenry County State’s Attorney Patrick Kenneally issued a letter today regarding criminal complaints filed by us and Karen Lukasik.

“We have completed our investigation into the allegations that Mr. Allen made regarding Robert Miller, Anna May Miller, Douglas Helman and Andrew Rosencrans and allegations that Ms. Lukasik made regarding Andrew Gasser, Charles Lutzow, and Ryan Provenzano.”

As if we don’t have enough confusion in this state, the letter appears to raise more questions that may never get answered.  According to Kenneally, it was his intention “to have the Illinois State’s Attorney Appellate Prosecutor determine whether criminal charges were warranted and if so, handle any subsequent prosecution”.  The Appellate Prosecutor has declined to serve in the capacity of a special prosecutor, citing “lack of personnel and resources.”

Note that he did not say they made that decision because of insufficient evidence.

Then he closes out his letter by claiming there is insufficient evidence for his office to seek a special prosecutor and states the allegations raise issues most appropriately resolved in civil court, just as he cited in his initial investigation on other matters.

We are waiting for confirmation that this letter includes the time card issues raised well after our initial criminal complaint. We will update when we know more on that matter.

It should be noted this letter made no mention of the criminal investigation of the Township Attorney James Kelly.  We understand that matter was forwarded to the state as well.

    So, in other words, “have a taxpayer file a civil suit” … Because the taxpayer needs to spend more of their money to this state in order to get relief from corruption???? Just what, exactly, do these states attorneys and appellate prosecutors do for the taxpayers anyways????
