Algonquin Township Attorney James Kelly failed to respond to complaint

By Kirk Allen & John Kraft

On February 28, 2019

McHenry Co. (ECWd) –

“On February 7, 2019, James Kelly appeared on behalf of the Defendant CHARLES A. LUTZOW, JR, but failed to answer or otherwise plead in this cause of action as required by the summons.”

Kelly’s failure to answer or otherwise plead in the case has now lead to a motion for Default Judgment against Lutzow, the Township Supervisor who failed to establish Road District Bank accounts in the name of the Road District.   The motion was filed on February 27, 2019.  We covered the action taken against Lutzow in this article.

Past reporting by local media in McHenry County made a clear misrepresentation about a missed filing by the Algonquin Township Road District attorney Rob Hanlon – because he was not the attorney handling the case when the response was due.  We covered that in this article.

We make two predictions. The court will give Kelly time to respond and local media will not expose Kelly for his failure to answer the complaint, a real fact.

A copy of the motion can be downloaded at this link or viewed below.
