School Board Member files amended complaint in federal court –

NEWTON, IL. (ECWd) –

Jasper County Community Unit School District #1 board member Jerry Earnest filed an amended complaint in Federal Court on May 25, 2018.

Count 1 consists of a “Claim for Deprivation of a Liberty Interest” in that the district prohibited his access to the same school records, and in the same manner, as every other school board member, which prohibits his performance of duties listed in the Illinois School Code, that the district has attempted to impugn the integrity of Mr. Earnest thru a censure and inhibiting his access to school district records, the board prohibits him from accessing the district’s Dropbox account while all other board members have access to it, all the above with no hearing or due process provided Earnest. He is seeking damages, and full and complete access to district records.

Count 2 consists of prayer for Declaratory Relief, in that Earnest has been improperly stripped by governmental action of his liberty interest under the US Constitution to hold public office and pursue his public service as a member of the Board of Education.
