AG: Not enough evidence to determine Jasper Schools held improper closed meeting –

By John Kraft & Kirk Allen

On February 23, 2018

NEWTON, IL. (ECWd) –

The Illinois Attorney General’s Public Access Counselor issued a determination letter stating that it was “unable to conclude” and their office had “insufficient evidence” to determine that Jasper County School Board held an improper closed session meeting-after-the-meeting on December 18, 2017.

This stems from the incident where a school board member made a false 9-1-1 call, and then closed the door with a majority of a quorum present to discuss the incident for which the false 9-1-1 call was made.

Please keep in mind that this is not a determination that the school district did not violate the Act, but merely a determination that the PAC was unable to conclude, based on insufficient evidence in their office, that the board violated the Act. We note the clear distinction between the two, where if the PAC determined no violation of OMA occurred, it specifically stated as such (see 3rd paragraph on page 6 of this pdf).
