Watchdogs file suit against College of DuPage –

This morning, the Edgar County Watchdogs, and For The Good of Illinois’ Adam Andrzejewski, will file a lawsuit in DuPage County Circuit Court alleging that Open Meetings Act (OMA) violations occurred last Thursday, January 22, 2015, while the board conferred the severance package for Dr. Breuder.  In anticipation of the lawsuit, the college has called for a special meeting on Wednesday, January 28, 2015, at 7pm for the stated purpose of “Approval of the Fourth Addendum to College President Robert L. Breuder’s Employment Contract“. 

Our legal counsel, Timothy Elliott of Rathje Woodward in Wheaton, has also included in our lawsuit that the remedy for one of the alleged OMA violations must include a venue change. The special meeting must be moved to a room large enough to accommodate the anticipated large crowd.  This is in keeping with the Illinois Open Meetings Act, in which meetings must be held in a place that is both “convenient and open to the public” Gerwin v Livingston County Board. The current board room lacks the capacity for more than 50 citizens, including the press and reserved seating, and we believe that COD is required, under the Open Meetings Act and the Gerwin decision, to hold the meeting in a venue large enough to accommodate the anticipated large crowd. The on-site MAC auditorium would suffice.

We call on all citizens and stakeholders to use their right of a three minute public comment during this special meeting to voice their disgust of the egregious pay and perquisite package.  With hundreds of citizens weighing in with concerns, we hope the board comes to its senses and stops the nonsense.

This is the second suit we have filed against the College of DuPage this month, the previous being allegations of violations of the Freedom of Information Act (here).

    Is there any way to get an injunction against further action by COD to prevent this heedless movement to approve an outlandish severance for Breuder? Its clear that Breuder and Birt are afraid the winds of change will sweep through the Board of Trustees in April and are pushing this through with little regard for the law.

    By all means STOP this maddness brought on by Breuder and his `friend“ Ms Birt. Do not let them get away with this payment and the perks. He has probably stolen that amount plus by useing the phoney billing practices they have presented to be paid by the COD, the students and tax payers. To bad his bank records can’t be looked into for extra deposits over and above, maybe even family members banking accounts. From what I’ve read about him, I wouldn’t trust him any further than I can throw him. There’s more shit going on than what we realise. Keep digging for the whole truth!
