Update: Vermilion County Regional Airport Authority: Two Commissioners fail residency requirement –

We previously reported that 4 of the 5 commissioners cannot hold the office of Airport Authority Commissioner in Vermilion County because they are members of the governing body or an officer or employee of a municipality, a county, or any other unit of local government. This disqualification can be found in Section 5 of the Airport Authorities Act.

On top of being disqualified from serving as commissioner for the previously reported reasons, another qualifying factor to serve as an Airport Authority Commissioner is to reside within the Authority’s taxing boundaries, or “territory.”

We found that two of the five Commissioners fail on the residency requirements and cannot serve for that additional reason, and can be found in Sections 3.1(d) and 3.4 of the Airport Authorities Act.

  • “must reside within the territory of the authority”(70 ILCS 5/3.1(d))
  • each commissioner shall reside within the Authority and shall continue to reside therein during his term of office” (70 ILCS 5/3.4)

Commissioner Jonathan Myers does not reside within the Vermilion County Regional Airport Authority’s taxing boundaries and cannot serve on the Commission for that reason. See his taxing bodies (here and here).

Commissioner David Kietzman does not reside within the Vermilion County Regional Airport Authority’s taxing boundaries and cannot serve on the Commission for that reason. See his taxing bodies (here).

Commissioners Tom Day, Steve Foster, and William Ingram DO reside within the Vermilion County Regional Airport Authority’s taxing boundaries, however, Commissioners Foster and Ingram remain disqualified for reasons discussed in our previous article.

This still leaves Commissioner Tom Day as the only qualified Commissioner on the Vermilion County Regional Airport Authority.

    Sounds like they haven’t been doing a good job checking about who can/can’t be on the commission before chosen.
