Did Des Plaines School District 62 Associate Superintendent Paul Hertel file false criminal complaint against citizen?

Back in the fall of 2016, Paul Hertel, Associate Superintendent of Des Plaines School District 62 filed a complaint with their local police department complaining about frequency of emails sent to the district.

Deborah Wilson submitted various Freedom of Information Act requests, and sent multiple emails to the school district employees and its school board members.

We acknowledge some of the emails could be lengthy and numerous, but never to the point of threatening or interrupting. Paul Hertel, Associate Superintendent of Des Plaines School District 62, filed a criminal complaint with the Des Plaines Police Department alleging that Wilson committed that act of sending a “volume of e-mails were harassing in nature in that they interrupted Hertel’s and District 62 employees’ telephone and electronic communication service.” (read it here).

The complaint also alleges she sent the emails after being told not to contact Hertel or any District 62 employee – something taking a Court order for it to have any legal ramifications, but that didn’t bother Hertel, he was on an apparent mission to assault the first amendment rights of Wilson of petitioning the district board members.

District 62 is a public body, and as such, the public has a first amendment right communicate with and petition their public officials and public employees. Paul Hertel may need to attend middle school civics classes again for a refresher on the first amendment – he is obviously clueless.

Last week, I submitted a FOIA request for any documentation of any “claimed interruptions telephone and electronic communications services” between the dates listed in the complaint. I also asked for the reason or cause of any interruptions and the duration of the interruptions.

You guessed it – “The school district is not aware of any claims that District 62 experienced an interruption of telephone and/or electronic communication service between 5-11-2016 and 8-22-2016.”

I’m sure her defense attorney will be interested in that statement by the school district.

The next step is for some good citizen to file a criminal complaint against Paul Hertel and District 62 for filing a criminal complaint knowing they were filing a false police report to effectuate an arrest of an innocent person. It is a crime to file a false complaint with the police department.

4) Transmits or causes to be transmitted in any manner to any peace officer, public officer or public employee a report to the effect that an offense will be committed, is being committed, or has been committed, knowing at the time of the transmission that there is no reasonable ground for believing that the offense will be committed, is being committed, or has been committed;

(5) Transmits or causes to be transmitted a false report to any public safety agency without the reasonable grounds necessary to believe that transmitting the report is necessary for the safety and welfare of the public;

      Did you read the article? He reported “interruption” of telephone and electronic communication services when it never happened. How is that not a false police report?

    I mean, if you were getting on average 525 emails a month, I think that would interrupt my work. What’s your phone number / email? Let’s see how you like it.

      Are you counting each recipient as a separate email? Or each actual email with multiple recipient as one email? It makes a difference.

    Said attachment was not viewable in my original browser so I opened another and I can see what you are referring to now. Now I see the evidence. There seems to be something fowl going on

    Not all records can be released under the FOIA. Perhaps she was asking for information exempted from the FOIA?
