U46 School Board Member Janette Ward files suit against School District

U46 School Board member Jeanette Ward has requested to listen to closed session recordings multiple times, and the District has refused to allow it in spite of the legal precedent set in multiple court cases that ensure elected officials have access to records related to the public body they serve.

An agenda for tonight’s public meeting reflects an action item to destroy those records that will require Mrs. Ward to vote.  We first covered that in this article.   How can a person be expected to cast a vote on a matter when the records in question are kept from them?  Is this action being taken to hide incriminating evidence?  Is this the path elected officials take when laws are on the eve of getting changed to ensure elected officials have unfettered access to this type of information?  All indications are certain board members have something to hide and they will go to any length possible to protect the exposure of their actions behind closed doors, all while saying there is nothing to hide. 

Michael P. Adams, an Attorney with Rathje & Woodward, LLC has taken legal steps to protect Ward’s rights to access records. A COMPLAINT FOR DECLARATORY JUDGMENT AND INJUNCTIVE RELIEF and an EMERGENCY MOTION FOR TEMPORARY RESTRAINING ORDER have been filed today on behalf of Jeanette Ward with an emergency hearing scheduled for 3PM today in Kane County.

Copies of the filings can be viewed and downloaded below.   We will update as soon as we hear the results of the Emergency hearing on the TRO.   We do note that regardless of the TRO outcome, a complaint being filed against U46 brings certain record retention rules and any destruction of certain records may be viewed as destruction of evidence.
