Elgin Police Department Releases Report on U-46 Open Meetings Violation –

Elgin, IL. (ECWd) –
We have received, through the Illinois Freedom Of Information Act, copies of the Elgin Police Report, Case number: 2015-00064770 naming the U-46 School Board members as suspects. Even the board member attending via telephone was listed as a suspect since he was considered “present” at the meeting.
There is a narrative of the incident from the police officer’s recollection on pages 2 and 3 of the report (below).
It states that the Kane County State’s Attorney was contacted and declined to pursue charges against the board members “at this time” – which is completely within his authority to use prosecutoral discretion in determining which [alleged] crimes to prosecute and when to prosecute them.
I also asked the Elgin PD to provide all radio traffic and body-cam video in the FOIA request, but it was not provided yet. I have asked them to provide it. Additionally, I have sent a FOIA request to the Kane County State’s Attorney for a copy of the “supplemental report” referred to in the Elgin Police Report.
