Marion, IL. Police Abuse Video –

MARION, IL (ECWd) –

After reading an article in the local newspaper that covers Marion, IL. That paper said the city attorney stated that the video would not be available because it was part of “personel records” – wrong answer…So I submitted a FOIA request for the video of an alleged Police Abuse case with the Marion Police Department.

This incident occurred on February 10, 2013 when a person was brought into the city police station. Officer DeMattei was observed on video kicking the prisoner while he was handcuffed and face-down in the prone position.

At 2:23 in the first video, he is brought in and an officer lightly kicks him. At 2:42 an officer comes out of the office and kicks him in his left side then throws him into the bench. Then at 2:59 that same officer grabs him by the ears and slams his head against the wall three times.

In the second video, the prisoner goes from sleeping to aggitated back to sleeping.

In the third video, at the 10 second mark they put some type of bag over his head, presumably because he was spitting.

In the fourth video, at 5:40 they take him to get fingerprinted.

In the fifth video, fingerprinting starting at the 5:48 mark

In the sixth video, more fingerprinting…

In the seventh video, at the 5:01 mark they take him out of the office, thru the holding area, and outside.

This resulted in the City turning over the investigation to the Illinois State Police, who within 24 hours, turned it over to the FBI. A settlement was later made between the F.O.P. and Marion Patrolman Byron DeMattei in which he was put on unpaid suspension for about 4 weeks (Mar 23 – Apr 19, 2013).

We are unsure at this time if criminal or civil charges were ever brought against anyone involved.
